Nah, pretty sure Landry and Bart are not friends. Bart is supports abortion rights and refused to donate to Jeff’s gubernatorial campaign when Gordon called and asked him to.

But do we? Maybe with social issues. But with fiscal issues, especially one of our biggest Achilles heels, insurance / tort reform….doesn’t at all feel like we someone in our corner.

The bill isn’t even close to what is needed on legal reform. Bart knows this and that’s why he’s glad it passed because he isn’t going to be impacted whatsoever.

Only fools think this bill will change the legal landscape

Louisiana needs more quality insurers, not plaintiff attorneys

Allied Health in Lake Charles LINK by far the worse these days in SW Louisiana

Others:
Lafayette Bone and Joint (Muldowny, Blanda, Trahan)
Louisiana Orthopaedic Specialists (Lasseigne, Baronnes, Neil Romero)
Interventional Pain Specialists (Wyble, Gros)
George Williams

Many more to name. These are the names that are repeatedly seen...injections to RFAs to surgical rec to settlement, or if no settlement, a surgery that usually makes pain worse in at least 80 percent of cases.

I know many here practice and know exactly what I am talking about. For those that dont, it is proably a lot worse than you think it is.

Just like the Great Tort Reform they snuck through in the summer of Covid, and the package from last year, this one will not lower your car insurance rates.

At what point will the citizenry hold their legislators accountable for lying that taking away rights will result in lower premiums?

It’s no different than the Patriot Act. Let us take away your rights/freedoms, so that we the great and powerful Oz can protect you.

Buddy of mine was driving a nice car "new" merging off the highway in Shreveport when a "piece of crap" car slammed into the side of him.

There were five occupants so they all claimed he was at fault and guess what, all sued him for personal injury and won.

And by some miracle they all knew the exact amount, to sue for, where the insurance company doesn't waste money disputing it.

ALL 5 Of Them

He said they were going less than 30 mph.

This is the type of bullshite that needs to stop

If I were taking a guess, I would say we have a generational culture of lawsuits that has us ahead of the curve because Morris Bart essentially invented the “billboard lawyer”. And I don’t mean in the south; I mean nationally. People like Cellino and Barnes in New York learned the playbook from him.

We have people who have spent their entire lives believing that car accident = payday. Unfortunately, I think it’s only a matter of time until other states start following suit. No matter where I drive on the gulf coast, from Texas to Florida, PI attorneys make up the majority of billboards. And the problem is that there really aren’t any laws you can pass that will get rid of the “insurance limit soft tissue” claim everyone hates without blocking a massive percentage of legitimate injury suits.

But like I said, just a guess. But if someone is aware of some magic law Texas, or anyone else, has, by all means. I’m certainly not aware of one.

I've said it here numerous times, but Morris Bart throws a Christmas party every year for the doctor's he exclusively uses to make up injuries for his clients.

There is no possibly way that you can sufficiently hate ambulance chasing lawyers.

That's definitely a big part of it -- the general legal climate. Most people in Louisiana, especially South Louisiana, hate insurance companies largely because of negative firsthand experiences with their own hurricane claims. These are the people who make up the jury venire.

And then the state bench is mostly former plaintiff lawyers with a liberal view of the legal system and its purpose. And they are subject to, and are influenced by the plaintiff bar via large campaign contributions, because we have publicly elected state judges (bad idea).

Thus, getting back to my earlier post in this thread, all the billboard lawyer needs to do is simply get the suit filed in state court. Once there, he's holding all the cards and has all the leverage, thanks to the aforementioned legal climate and the makeup of the jury venire and state bench. If he's not totally incompetent (some are) he'll get a settlement from the insurer that is way higher than it should be.

That's why you need a system to keep auto claims out of state courts and away from the judges and juries. Either a pre suit review panel, or a separate tribunal like workers comp.

My car insurance went up $100 per month last month. No wrecks, nothing. Just did.
