This is definitely an interesting case. Here is the statute they charged him with:

quote:

(A) No person, for the purpose of sexually arousing or gratifying the person's self, shall commit trespass or otherwise surreptitiously invade the privacy of another, to spy or eavesdrop upon another.

(B) No person shall knowingly commit trespass or otherwise secretly or surreptitiously videotape, film, photograph, broadcast, stream, or otherwise record another person, in a place where a person has a reasonable expectation of privacy, for the purpose of viewing the private areas of that person.

(C) No person shall knowingly commit trespass or otherwise secretly or surreptitiously videotape, film, photograph, broadcast, stream, or otherwise record a minor, in a place where a person has a reasonable expectation of privacy, for the purpose of viewing the private areas of the minor.

(D) No person shall secretly or surreptitiously videotape, film, photograph, or otherwise record another person above, under, or through the clothing being worn by that other person for the purpose of viewing the body of, or the undergarments worn by, that other person.




Not sure which one they charged this guy under. They all seem like a stretch for the alleged conduct.

This is supposedly the law they are using.

There's more to it than that, I posted it above.

But all of it is based on viewing someone not sniffing an article of their clothing.

He also would have needed to be trespassing or surreptitiously lurking in his own house. Definitely seems very shaky to me.

What he did was pathetic, but it looks like they couldn’t find anything better to charge him with. Assuming it was his home and depending on exact kind of relative she is and why she is there they will have to proof he had no business being in the room at all and then show how sniffing fits spying or eavesdropping, viewing private areas of the person, or videotaping or otherwise recording her underwear worn (worn would have to include being worn in the past not just mean what she was wearing when videoed).

Is it going to be stretched to recording memories of the underwear in his mind??

Also depending on the nature of their relationship and being under his care he might have expectations of privacy in his own home.

The above paragraph states she is a minor, and I am surprised that they could not find a crime dealing with a minor on this rather than charge with a voyeurism statue.

They would have also charged him with trespassing.

…if he wasn’t trespassing, God help any dude that walks into Victoria’s Secret with prurient intentions.

This is one of those situations where you can escape the charges but not the process.
