A) He specifically requested accommodations. He wasn’t asking for extra credit on his performance evaluations or anything like that. He just didn’t want a surprise birthday party.
B) They ignored his request.
C) He had an adverse reaction.
D) He was fired undoubtably for the adverse reaction.

This is a slam dunk disability discrimination and wrongful termination lawsuit. $450k sounds like the company got off easy.

Gotta say, I agree with this verdict. He told them it gave him anxiety, what he said would happen actually did happen, and then they fired him for it.

Lunch time is my time abs i can either run an errand or eat what i want. It wastes my free time

For all of you who are cheering this guy on for winning his settlement, why?

Sure, it was a dickhead thing to do, but just writing a check for $450,000 seems a little excessive, no?

What’s the justification?

He got fired, dude. The company is in the wrong, but he bore the burden of a termination on his resume which probably has damaged his employment prospects.

Considering the lawyer gets a third, that means he keeps about $300,000 of the settlement. He was fired 3 years ago, so that comes out to $100,000 a year, which when you factor in lost income and the punitive damages he would be reasonably entitled to, $100k a year sounds about right.

Edit: I mean, how fricking hard is it to not throw a surprise birthday party for a guy who has just told you not to do so because it will trigger a panic attack?

Good Lord, this country has become so weak. The entire mental health industry is a bunch of snake-oil flim-flammery. It makes me laugh how many people have convinced themselves that they can't get through the day without some therapist or shrink holding their hand (for a fee, of course.) Pathetic.

There's gotta be more to the story, right? Why would a company purposefully antagonize him against his wishes, then fire him? Did they not understand his condition and think he was just being modest by not wanting a birthday celebration? What all did he do / say to his boss / colleagues about it the next day?

It went through a trial so I assume the evidence was pretty good for the dude to win. It's just such a bizarre story.

Probably not an “intentional” antagonization. Probably just dumb HR failing to inform management and workers to not take health-related requests lightly.

Whoever was in charge of birthday celebrations probably doesn’t have first hand knowledge of the severity of anxiety disorders and thought “what the hell, let’s throw it for him anyway.”

That, or, they simply forgot his request.

I’d much rather them continue to write huge checks to uninsured, unlicensed drivers who fall out of their car with a neck brace on when someone barely taps their back bumper.
