Actually if you read about the case it appears they did announce they were cops. Part of his affirmative defense was that he was deafened by the flashbang and couldn't hear them yelling POLICE POLICE POLICE or whatever SWAT teams usually say when serving no-knocks.

Which seems pretty reasonable albeit a complicated case. The warrant was based on a huge amount of cocaine being trafficked through the house yet nothing was found.

So the drug war is worth the threat to innocent bystanders?

Why not just get them in a traffic stop or another time. Why go in the house with flashbangs if you aren't 100% sure the target is in there. It's one thing to support the police and understand their are mostly good shoots, it's another to realize things like No-knock warrants and civil forfeiture are horribly overused.

All another black eye on the failed war on drugs.

Anything you do after tossing in a flash bang doesn't count. Police know this. The whole idea behind using a flash bang is to prevent others from being able to think clearly.

I agree that the a SWAT team probably followed the guidance of a case detective who sucked at his job. I would imagine the key to a narcotics search warrant is to obtain both your dealer and his dope at the same time. What's the point if you get one and not the other. And to come up short on both in this case is just bad work.

However, I think traffic stops are fine but you also lean on the possibility of the suspect running in his vehicle causing a pursuit that might last feet to miles. How many people are in harms way once that happens. The will of a man not wanting to go to jail is pretty strong at some points. What if he exits his vehicle during the traffic stop and immediately begins shooting? How many innocent people are then caught in that crossfire? There is no right or wrong way to do this IMO. It's a shite sammich either way.

Well to be fair to the officers there was likely no crib with a toddler to toss the grenade into confusing with them as well

This is the result of lazy police work, instead of surreptitiously waiting to see if the person they wanted was there, they chose the ole lets just go toss grenades in the house and go in guns a blazin routine.

Did not work out for them thankfully.

Seems to be the going rate for wrongful imprisonment.

I cannot wrap my mind around the fact that over a kid possibly selling drugs, police would go in with flash bangs and no knock, yet be surprised when the homeowner protects himself.

It boggles the mind. And it's worse now knowing that they KNEW they did it wrong. That's why he'll win civilly.

How is it possibly capital murder when a cop is shot, but not when the cops kill An innocent person in the house?

The reason these chickenshit no-knock warrants are handed out in the first place is because we as a society have a flawed view and believe that drugs are morally wrong. So many have been spoonfed this shite and cops and judges literally believe they are doing right by enforcing such terrible laws. It will never change until we have a complete overhaul on the American populations views towards the legality of drugs for recreational use. Couple that with the fact that the War on Drugs is a gigantic industry and it's and extreme uphill battle which is disheartening because one would think that such a simple concept would be easy to grasp for the majority of the people. frick this judge, frick these puppet cops, and frick the assholes that continue to support these laws that allow this to happen.

No knock warrants shouldn't be legal at all.
