Her testimony is that there was mutual oral sex, he started bragging about hooking up with her and her roommate, she felt uncomfortable, said no, and pushed him away. He pushed her head down till he finished.

Probably because he was black out drunk at the time getting sexually assaulted. Also, he didn't have access to those text messages at the time. Do those messages sound like they came from someone who just got assaulted or by someone who just raped an incapatacitated (and puking) person?

ETA- By Amherst's own standards sexually engaging an incapacitated person is sexual assault. Why is she getting a free pass on that?

One of the major walls against filing a false rape claim is that you have to go through a trial and possibly put an innocent person in jail.
With these tribunals the worst that will happen is the guy will get kicked out of school. Not such a life altering event in the eyes of an embarrassed or vindictive woman.

I'm not sure if he was even allowed to testify. Regardless, they deliberately denied him access to crucial evidence (texts) that could have exonerated him or at least brought a different perspective to the case. This was clearly a kangaroo court in which the defendant was guilty until proven innocent.

I have no idea what happened that night, but I know it is ridiculous to deny someone was raped based on those text messages. How exactly are texts from someone who was raped supposed to sound like?
She's probably getting a pass on the sexual assault because they were both drinking - instead of charging both they charged neither

Yeah, I would imagine someone who just got raped wouldn't frame their texts in the format of "uh oh, I just fricked so-n-so".

Nope. The school charged HIM, but not her with sexual assault. He gets expelled for sexual misconduct (try explaining that to his next school) and she probably graduates. Makes sense.
