the supreme court cannot ever argue again that the bar exam is a necessary or prophylactic step. they just invalidated the purpose of the bar exam entirely
I wonder how they will address the criminal defendant who alleges incompetent representation because he was represented by a "no bar exam" lawyer?

Split applicants in half by lottery. Half take it one week, socially distanced, and half take it the next week, same way
Make big deal about two versions of the test. Then just give them the same version.
So easy

If I had already put in hours of studying over the summer, and now had additional time to study before taking it in October, I would take it.
I'd likely take it just because I'd always have that feeling in the back of my mind that I was being looked down upon or judged because of circumstance
I would 100% be self-conscious about being a new lawyer with no bar passage under my belt

You would need 2 tests. And honestly if one has a statistically lower passage rate look out.

There’s plenty enough vacant space in the state that it could easily administered to everyone at the same time.

Go luck getting hired or getting malpractice insurance.
That being said, the bar exam is a right of passage more than it has anything to do with the practice of law.

It’s mostly a gatekeeper for out of state attorneys.
But yeah there are plenty who pass who are terrible attorneys.

Was sitting with a law clerk today when the news came out. He interrupted me to tell me that "I'm now a lawyer". I guess I'm happy for him but disappointed that they don't have to endure what we did.
It is a similar feeling as when fraternity hazing was abolished.

I’m only here for the Louisiana trial lawyer melts.

this is fricking hilarious. From now on every lawyer I talk to I will ask what year they got into the BAR, if they say 2020 I'll make sure everyone I know knows not to do business with them because they aren't really a lawyer

That’s what I’m thinking. If you get DP, won’t firms give preference to people who actually passed the bar exam?
Who is more likely to get hired? An LSU Law grad with a B range GPA who passed the bar on their second try or a SULC grad with a C+ GPA who got diploma privilege?

the people who don't give af the most are probably the ones for whom the bar exam exists

Sure. But it also acts as one last chance to cull out some dummies.

An LSU grad who graduated last in his class and failed the bar 4 times and has three DUIs is getting hired before the president of SLUC’s law review who passed on first shot. Hypothetically speaking.

we offer no bar reciprocity to other states and yet we are not requiring our own lawyers to pass the bar
Posted on 7/22/20 at 1:35 pm to SlowFlowPro
I just read the Crain dissent and he was spot on by why this is a horrible idea. Even California and New York have resisted going this far.
Posted on 7/22/20 at 1:37 pm to brewhan davey
What a terrible "solution." At best, this should have been a deferral and a requirement to take it in 2021 and just add another testing date for these candidates.
How can you effectively govern the bar and the licensing when you're admitting attorneys without any minimum requirements? As others have said these people will all have an asterisk by their names.

it opens up a whole can of potential legal issues and ramifications
but they will kick this can so far down that road that it will circle the globe and hit them in the arse
