Going to be tough to prove. Especially if she had painful, multiple lumps, usually fibrocystic or fibroids, and unless high risk; they usually don’t start screening till age 40. Cancers are usually painless, so when she told her Dr about it, probably thought benign, right off the bat at her age; but we are seeing earlier in patients with gene mutations and genetic predisposition

Good luck with that. The caps on med mal make it difficult to bring claims except slam dunks. Have the caps been raised since the 70s? 500k and that includes economic.

Wagar Hickman attorneys in Mandeville, very successful med mal attorneys and that’s all they do. They will review everything for free and be honest with you if you have a case or not.

Sorry about your wife. This is why the non-medically oriented people really need to try your best to put take charge of your own health related problems/questions. If you disagree with a doc, go to a second one as soon as you can get an appointment! I would venture to guess about half the inobvious diagnosises are incorrect. I'm on my third doc for one issue and I finally got the correct diagnosis last week, 3 months after starting. And this isn't the first time it took 3 different docs to get the correct answer. (not blaming anyone here OP, its just a common occurrence.

Sounds like she had virtual visits (phone or video?). Did they even have screening studies (mammogram/ultrasound) readily available at that time, or was everything shut down during covid?

Any family history of early onset breast cancer? Recent childbirth or beast feeding?

Is there even an established “standard of care” when the doctor can’t even do an adequate physical exam due to covid?

You must prove all three of the following:
A: doc deviated from the standard of care
B: harm/injury occurred
C: “A” caused “B”

Sounds like a tough case to prove malpractice.
