Strange bill all around, $10,000 jury threshold but no 2 year prescription. Collateral source limited, but presumption Plaintiff gets 40% of difference as cost of procuring health insurance.

I think LABI got their big items, and I rather the Governor to have signed the other bill Talbot fricked up on. Alas, we now have tort reform. Let the rate decreases flow and get ready for Amazon HQ3. We are now the Mecca of business and industry.

I’m tired from a long day of bankrupting mom and pops and I’m gonna hang with my daughter, but discuss amongst yourselves.

Why no 2 year prescription? That seems like a no brainer. Many suits would not have to be filed

Does this mean y’all are going to have to practice real law now?

no 2-year prescriptive period means this isn't about lowering rates and is more about punishing plaintiffs

Lol how was 40% arrived at? All this will do is have Chiros agreeing to hold bills And not run through insurance even more in demand. Chiros are the winners here.

Looks like they aren’t repealing the direct action statute anymore either.

I think it would be good for all including the insurance companies. More of a chance to settle before suit has to filed and litigation expenses start. And good for the plaintiffs themselves because most plaintiff attorney's percentage taken under their contingency fee contract increases once suit has to be filed.

Sachertorte is hands down the winner. Especially if eaten in Vienna. Sehr gut.

I don’t understand how people could be against this. It would instantly reduce litigation while also not diminishing anyone’s rights.

Let’s have a reminder to revisit this thread in a year and see how this pans out. I doubt that the average Louisiana driver will see any noticeable difference in their premiums.

Congratulations Louisianans. Giving up rights so multi billion dollar companies can make more profits.

This will not move the needle on rates. It may cause plaintiffs more delays getting on the docket for trial. Also will help defense attorneys get more claims as the ins co play with their new found toy. At the end of the day it doesn't do a whole lot. The state needs to really crack down on all the bums driving with NO insurance coverage at all. This is what is really driving the stupid rates.

We aren’t serious about no insurance in LA. We aren’t serious about much. See DUI and the pre trial scheme with DAs. What a joke.
