Good God, your attempt at handling this yourself has clearly been a disaster, so naturally, come to a message board for legal advice.

Use a lease and a management company next time.

Seriously, Who the hell puts floors in a house they are renting. Was she paying you rent too or was this a form of rent. No lease?

To recap:

- You didn't sign a lease with the tenant.
- You let the tenant upgrade your floors
- You decided to sell the house months after the upgrade, kicking your good tenant out.

I agree the move was not very Christian like but she was the one who pulled the trigger before an agreement was made.

Floors were about $8,500.
House was empty for 4 months after she moved out. We verbally agreed she would stay until we closed on the home. I had to pay the 4 months on an empty house. Not to mention $200 worth of utilities per month.

What if I take the monthly rent times 4 and deduct from floors and pay her that?
I know this is all because of me not being "clear enough."
By deducting the 4 months would make "my cost" of the floors $2,500.

She had just gotten a divorce when she rented the house. Was very excited and bragged about the huge settlement her "dumbass husband" was having to pay. This was one reason she was so quick to "front" the cost of the floors before an official agreement was made.

A uniform lease agreement would state that the lessor owns all improvements. Why would the tenant put new floors in without any kind of an agreement at a rental .. She's just as dumb as he is for not having a signed lease .. He just needs to arrive at a figure and have her meet him at the closing ..

No, this was just a way to make my payment to her lower.

There was never a true verbal agreement on paying for the floors BEFORE they were installed.

All I ever said about paying for the floors was "we will see" but this was after she agreed it was alright to sell the house and she would stay until we closed.

I am not asking for morale advice. I know where I stand there. I was simply asking for what you guys thought would happen financially.

How does this make any sense at all? I'm not saying don't start at 2500, but your calculations are weird.

This situation is truly bizarre. Who the frick installs flooring on a rental house? What landlord allows that?

No real agreement to pay for the floors, but you insinuated you might.

No real agreement for her to stay in until the house was closed on, but she insinuated she would.

I think the $2,500 is fair because of that.

I did improvements to my rental home (fence, paint, appliances, etc) but always got approval first from the landlord who would reimburse me for the materials cost.

So not only did she pay for floors in a rental without a written lease or written agreement to compensate, but she actually knew the house was being sold and she'd have to leave?

Unless this chick likes throwing away money not to mention the inconvenience of living with floor installation, she must have believed either 1) she would be repaid or 2) she would be staying there indefinitely, thereby getting the use and enjoyment of the new flooring.
