The state said they didn't know who dropped off the drone video and just found out last week it was Brandon Beaman. However, Brandon Beaman was on the state's witness list from the beginning. So, they knew all along.

The fact that the judge has yet to call a mistrial with prejudice is insane.

On top of that, the two ADA’s, and possibly the DA, should be disbarred.

If I was convinced of guilt or innocence, I certainly wouldn't change my opinion just to get to a verdict. And I imagine the chance that another jury member could come up with something to change my opinion would dwindle to nothing pretty quickly.

The defense needs to be dropping motions non-stop, or at least adding to existing motions. They need to demand a mistrial from the judge. They are simply too passive.

Just read on Sebastian Gorka's tweeter that the defense was overheard saying it's a 6-6 split amongst the jurors. Didn't mention which charge.

I guess I was hoping the judge was going to tell them they would stay in the jurors room until they reached a verdict. He could send them each a ham and cheese, on Bunny, every four hours until they finished their job.

I'd find Kyle not guilty but I don't think it's unreasonable to think that there are serious issues jurors would struggle with like:


Whether they saw Kyle raise his weapon towards Rosenbaum on the drone video when he encountered Rosenbaum just before Rosenbaum chased him and got shot (I couldn't tell and, as we know, the defense made a good case for the zoom function adding artifacts to the video so the video couldn't prove it one way or another)

Whether Rosenbaum grabbed his rifle just before he was shot (there was no DNA or fingerprint evidence shown to prove that although Rosenbaum did have gunshot residue on his hands).

Whether Kyle had exhausted his escape options before he shot Rosenbaum.

And with the fact that Kyle fired multiple shots after the first one incapacitated Rosenbaum but didn't kill him (though the 4 shots only took about 0.75 seconds so he was not spending time assessing Rosenbaum's condition).

And there is the question of whether Kyle went looking for trouble (he essentially testified that he knew leaving his crew was dangerous), pointed his weapon at another dude (in video Kyle tells the dude he did but explained it as a sarcastic comment) and just should have stayed at the location he was guarding with his crew (although he has the legal right to walk around carrying wherever he wanted).

The case seems to me to boil down to what happened with Rosenbaum because everything flowed from that. There is also the issue of whether Huber, jump kick man and Grosskreutz legitimately believed that Kyle was an active shooter who needed to be stopped (although Kyle talked to Grosskreutz as they walked and said he was turning himself in to police, Grosskreutz said he misunderstood him).

If I were on the jury, I would take these issues seriously, although I would find Kyle not guilty.

And I'm pretty sure they vote on each charge so it would be multiple sets of votes.

We don't do that with Congress (and we should) so why would they do it with a jury?

If Richards was even halfway decent, they wouldn't even debate this. It's literally part of the law he doesn't have to do that.
