It doesn't say she was menacing anyone. Another student made it known she had a list.

Read the statute for menacing. And what does it matter who made it known? That doesn't have any impact on the legality of the action. You can't cook meth in your house legally, but when someone rats on you it magically becomes illegal. That's not at all how law works.

And, the guy you're arguing with is suggesting both parties, the girl and her bullies, should face repercussions.

I'm for punishing those who broke the law. Being a mean kid isn't illegal.

Dude, just give it up.

You're in over your head.
Sorry you got bullied as a kid, and I get you want to rail against mean kids, but you can't commit a crime to drive that point. It doesn't work like that.

You don’t know that’s all that happened. Just STFU.

Please point me to the statute that criminalizes being mean.

You can try looking in LRS 14, but I think you'll come up empty.

Let me know, though.

I did and obviously comprehend it better than you. The key element is "the intentional communication..." Nowhere in the story does it say she intentionally communicated anything.

quote:

Menacing is the intentional communication of information that the commission of a crime of violence, as defined in R.S. 14:2(B), is imminent or in progress or that a circumstance dangerous to human life exists or is about to exist, when committed under any of the following circumstances:

Nobody said the bullies should get arrested. The school though should mete out discipline.

You're right. She probably accidentally wrote the murder list. Drafting a hit list is in no way "intentional communication".

So she "accidentally" wrote out a hit list...gotcha.

Look no further than the third post in this thread. Someone is clearly butthurt that the SO won't go after the "bullies."

You must really really trust your justice system to catch every single thing and never miss to be this sure about something.

It's a good thing the bullies have you here as their advocate. Not sure what they would do without you.

You're reading into the story. Good chance another kid saw it and told on her.

It's wild how absolutely certain he is about what the bullies did or did not do.

Maybe he's a parent of one of the bullies.

Right, which is why I mentioned how much he must trust the system and they must never ever miss and they know about every single crime ever committed.

this...

how much of an eye opening experience would it be for a 13 year old girl/boy to realize they might have been a day away from being gunnned down

Where did I say anything anything about "accidentally" writing anything? Writing a hit list does not qualify as Menacing. Why are you toiling away at a strawman? Again, nothing says she intentionally communicated anything. But keep creating "facts" so you can win your dim argument.

I'm not in favor of people being punished by the state for things that are not illegal.

Do you disagree with that? Should police be able to arrest people for noncriminal actions?

That poster you're replying to is making really bad arguments, but...

Correct, but someone seems to think she didn't just write it down, and that she did intentionally communicate it.
quote:

Again, nothing says she intentionally communicated anything
The charge of menacing that states it must be intentionally communicated says that she did this, no?

Well I have to imagine that she intentionally wrote it down, right? Like she didn't hold a pencil and gesticulate wildly until a set of certain names appeared on a piece of paper.

Even you can understand that, right?

How do you know they did nothing illegal? See my previous post, are you stating because they were not charged that means you know for sure they did nothing illegal?

No, I'm saying you have zero clue if the bullies were just mean to her or what they actually did to the person that was arrested. Do you disagree with that?

I never said it was accidental. That's what that post was about.
