Reading the story and comments from local sites, the prevailing thought from the "locals" is that he should have just sat back and called the police. Obviously they have no legal knowledge but this falls under the mantra of "a black child would be alive but for the actions of this white man." Hard to believe that people can argue that confronting a thief makes you the aggressor.

You are right...Not capital. Not trying to connect the two...Business owner in a heap of trouble. Will more than likely be convicted...of something. Not trying to defend the guy that was killed or his actions. At this juncture I can't defend the business owner or his actions either. Jury will decide...not me...nor you. Am not an idiot. Trust that you are intelligent enough not to say so.

I skimmed through the thread and this is off topic, but doesn't a poster write for that site?

I think someone said the owner of the site posts here earlier in this thread.

Yeah I think that's him. He has linked to it before. Seems he is getting some ad revenue on that site.

Damn, his daughter is a bartender here in Houma, she was telling us about it a few days ago.
Apparently when they indicted him the Marshalls picked him up. Someone called cops because he didn't show up to work. Poor daughter rushed up there and didn't hear he was ok for half a day

97-37-19 Ms Code. A misdemeanor, which at this point is the least of the car owners problem. He's been charged with capitol murder.
Thanks.
I haven't seen anything that indicates he was brandishing a weapon in the manner described in that statute.
I think this is supported by the fact that after the incident, police arrived, he was questioned, the mother was questioned, and others, and even after their statements he was released from the scene, uncharged, no arrest. If he was brandishing a firearm I'm confident they would have at least cited him or arrested him, taken him in, and made him wait around for a while as a decision was made to push further charges or let him go.

In this case, malice aforethought which can be formed the second before you act. In this case, the State would argue that he made the choice to go outside with a gun to kill the guy because he was stealing his car, which is illegal. He didn't shoot until the other guy charged him though, so I think that's a losing argument. Who knows in Hinds County though.
but did he pull his gun first before the guy charged at him? i think that's where this is going to end up

It seems he did, but..he didn't shoot till he was charged and the guy tried to take the gun from him.
He also had a weapon or object he was using to break into the vehicle. So he wasn't unarmed.

He gone.

He should be given a Presidential Citizenship Medal and cash award for the amount of money he saved the taxpayers as well as the lives/property he proactively saved from the worthless criminal animal he put down.

Maybe it's because he came out and confronted him. I live in the area and am not familiar with the story. Sounds like there might be a "the rest of the story"...
Uhh... He was trying to break into his car correct? The POS might as well have been in his bedroom.

In Jackson, the Castle Doctrine only applies to Indian convenience store owners who shoot a guy who just swiped a 6 pack of PBR beer. No charges are ever filed. The Indians have a hell of an association and even a spokesman and executive director.

As fricked up as this situation is I find it very hard to feel sorry for people who choose to live around people like this and then have something bad happen to them. By now people should know they or their family have a great chance of getting attacked and if they lawfully defend themselves they have a great chance of either losing everything or going to prison. It is great this guy took a stand against a bad guy but he should have known the other good citizens wouldn't stick up for him and now that he is in this situation he is either a hero or a dumbass depending on why he chose to defend his property.
