Yeah, also part of the settlement involved land, mineral rights and oil. She came out doing well for herself.

97-37-19 Ms Code. A misdemeanor, which at this point is the least of the car owners problem. He's been charged with capitol murder.

I'd imagine so. Contrary to what people believe, at least in MS (we're an equitable distribution state), property settlements are pretty much guided by the law and who you hire doesn't have some drastic, I'm going to frick the other person over effect many people think. If you were actually going to try a divorce for cause, then I would be sure to hire an attorney that is experiences in litigating, but other than that, as long as the attorney is competent there's not going to be much difference.

You're an idiot. First, simply brandishing a weapon is not illegal. Threatening someone with it is, unless it is justified, which in this case I'd say he was. Second, he's been charged with 1 degree murder, which is not capital murder. Third, if your thinking that by citing this misdemeanor combined with the killing is equal to a cap. murder charge then you are wrong. It's called the FELONY-murder doctrine for a reason.

well,..he goes out to see a man attacking and trying to possess his property. The man has an object he is using to do this.
In the moment, He feared for his safety and wanted the man to stop. Had he ran away and not attacked him, the deceased may still be alive.
What was he supposed to do? Make a mean face?

In a 1st degree murder case, does the accused get to choose jury members from those who are summoned?
Seems like I remember seeing or hearing something about when you are on trial for such a crime, you and your defense have input?

Short answer, yes.
It's called voir dire, and no matter what your charged with, both the defense and the prosecution has a set number of peremptory challenges (striking a juror for any reason so long as it doesn't violate Batson and its progeny) and unlimited strikes for cause.
