I hate to sound callous but how abominable an action is greatly depends on if they hurt somebody else.
Driving drunk is irresponsible and inherently dangerous to both the driver and others on the road. There are other activities that are also inherently dangerous and irresponsible but they don't become felonies until said negligence results in bodily harm to others.
We let some risky behaviors slide and rely on personal responsibility but for what ever reason DUI is something we severely punish people for even if they have not caused harm to others.
For instance: putting a kid on a 4-wheeler with you and stunting it around the yard is not necessarily a felony. My neighbors do this shite all the time and seem to enjoy themselves. If you get into an accident and that kid dies then your arse is going to jail and everyone will hate you.
Shooting your guns up in the air on NYE. You're probably not going to get charged with a felony. Hell, some OTer's neighbor shot bullets through his apartment and only got a misdemeanor. One of those bullets hits somebody and kills them then that same action now becomes a felony with years of anal penetration included.

Of course not. And to be honest I only read a page of this. I've been practicing as long as you and have defended several DUIs. I find you and your arguments tiresome.

Do you also agree that drowsy driving (>18 hrs without sleep) is similarly irresponsible? Would you call for people doing that to go to jail as well?

I practice criminal defense. I've defended DUIs and Yeah, DUI is a problem. Not so much te college kid who blows a .10, but there are guys who drive way fricked up, and they get caught multiple times which means they do it more often tha that.
I've also defended a couple vehicular homicides, and it sucks hearing about how a 19yr old girl was killed by someone so drunk he couldn't remember doing it.

The only problems I have with the current DWI process are unconstitutional road blocks, field sobriety tests that a sober person couldn't pass, and a willing passenger dying in a crash shouldn't send a driver to jail or trouble.

Quite the opposite. Guns are fine, they are not the problem. People are the problem. Alcohol is not the problem... idiots making the decision to drive after drinking rather than taking a cab "because they don't want to leave their car" is stupid as frick.
Your implied comparison is terrible. That is more like saying, well, let's shoot skeet in public with our guns! we won't miss and hit anyone!

I'm a fan of logic. So I'm quick to see the fallacies that are often rampant in these arguments. Like equating penalizing DUIs to total gun bans.

No. I giving you common sense talk. Or do you think the penalty should be the same for DUI whether they hurt nobody, or they kill people?
How about texting on your motorcycle with your teenage kid on it? How abominable is that? What if there's an accident while you're texting and the kid is killed?

I think penalties for any type of distracted driving should be catastrophic. We are far too lenient on any of these offenders, which is why it keeps happening.
