As with most crimes of this nature, the judge ought to have some serious discretion as to punishment involved. I know many people who are productive members of society who got DWIs. If you were to make it a blanket felony, you'd be taking those productive members of society out of society and making them a burden on it instead. Drinking is too widespread to have that happen.

What mandatory sentencing are you referring to?

A homicide can carry multiple and variable degrees and sentencing structures.
