The dirty little secret I’ve noticed quite prevalently is that probably 9 times out of 10, a public defender can and does net the same result as the 5 to 10 k privately retained attorney. But hey, if it makes folks feel better, I’m all for it.

Heavily jurisdiction specific. And hell, section/division specific within jurisdictions.
Good to great private criminal defense attorneys are worth their weight in gold if the case is complicated or otherwise has something unique about it, if there is going to be significant mitigation choreography, or if the client and/or their family need significant handholding. In short, more than anything else, they're being paid for their time.
A decent or better public defender will know the law and (usually) will have good enough relationships with the prosecutors and judges (again, jurisdiction specific) to get you through cases that don't involve significant time investment, which they simply don't have to give.
Mediocre to bad private criminal defense attorneys should be avoided, full stop. They won't know the law any better than the public defenders, they likely won't have better relationships with the prosecutor/judge, and they won't give you any more time than you can wring out of them. Hell, at least your public defender will always make your court dates, which is no guarantee in this tier of private attorneys.

Tell your friend to look up the revised statute on punitive damages. Only a few circumstances where they apply in Louisiana and drunk driving causing injury is one. Please tell him to get a good attorney.

0.2 BAC automatically places you ib the 3rd quadrant of punishment.

Subject B would still have the DUI on his driving record.

If you’re in real deep shite, I strongly recommend Carson Marcantel or his partner, Delatte.
Uh, speaking from a friends experience. Yeah, a friend.

Carson is now a judge in Baton Rouge city court, so you’ll probably have to scratch him off of your list, at least for now
A great attorney and a genuinely great guy, though.

NOPE - The point of this is that you don't need a lawyer to get 894.
I dated a girl who worked in the Clerk Of Court in a Parish in Louisiana, this is what she always told people she knew to do.
If you meet all conditions of the 894 it will not go on your record

This is true.

She probably should stop giving legal advice, because...

This isn't really true. While LA CCrP Art 894 does create a legal fiction of a "dismissal" and allows for a conviction to be expunged from their record, it can still be used as the predicate for an enhancement if you are later arrested for DWI and it will still show up in some record pulls depending on the agency. This is all because in order to have your 894 "dismissal" granted, you have to plead guilty and go on probation, and if you finish your probation satisfactorily, you can then get a retroactive "dismissal". But again, literally anyone who pulls the case record can see the guilty plea. And again, it can be used as a predicate for a DWI 2nd, etc. It's not a true dismissal.

Delatte.
Easily my favorite criminal defense lawyer to oppose in open court.
Motion hearings, when I was was sitting on a mountain of rock solid evidence, were comical. I will give him props for his theatrics, I am sure they intimidate and confuse the novice.
My contacts with Highway Patrol despise the guy for his tactics, I always thought they were fair game.

Considering cops can(and readily do) lie to suspects(potentially you and I) to gain advantage, they are the last ones who should be complaining about tactics.

One hurt or dead victim and your freedom and financials are gone, not to mention mental stress for all and guilt, as well as your reputation.

He won? I saw a sign that he was running for judge but never heard the results. I don’t live in LA anymore and hopefully I’ll never need him again anyway.
I agree, he is a great guy too. He did more for ‘my friend’ than he had to. Very genuine guy that cares about people. Baton Rouge has a good judge in him.

You don’t see about DWI checkpoints being posted anymore. I don’t believe BRPD does them anymore.

Yep yep. Was sworn in right at the beginning of January.

They were primarily driven by federal grants (which then turned into a massive overtime slush fund). I think the grants ended some time ago, so they aren't as lucrative as they used to be.
