There’s prob a simple fix for the OP (providing docs of no lapses in coverage) to the DMV, but alas, he’s spending his time bitching on TD.

Reminder: your agent is rarely a person designated to represent you if anything goes wrong. They are a salesperson meant to grow your holdings in their book of business. Like bankers, the company has them leveraging the relationship to sell shite and make you think the company is reputable and humane.

I would find an attorney and sue him AND THE STATE. Even if you have to pay the attorney and go after your legal costs. Folks need to do this to stop this nonsense. The most important thing is getting one of those OMV jackholes on the stand and explain why these lapses are so hard to resolve correctly.

Agents have to buy malpractice insurance
Like every other professional. Figure out what he did/didnt do, how much that cost you and mail him a letter demanding that amount and to put his insurer in notice.

Also, go to another agent and move your shite.

If you find an attorney that would sue the state over this case, then you need a new attorney.

It’s not the states fault they never got info sent to them by the new carrier showing you have coverage.

If you truly never had a lapse, you wouldn't have a fine. OR the DMV/State screwed up and proof of coverage with no lapse would clear up the issue.

You can't file a claim against someone's e&o insurance; only the policyholder can file a claim after receiving a demand (or lawsuit) from the damaged party.

All that said, it's possible the damages don't even meet his deductible and the agent will need to self insure this one.

You should out the agent publicly. Keep others from making that mistake. Also do you have an email trail or was this all done over the phone?

How great was the rate when you signed to bind coverage? How were your payments set up and do you use cc, eft or check?
How long after binding coverage did you receive your policy in the mail?
Your story has multiple holes in it.
Also, you cannot Bind, Alter or Cancel coverage via email or voice mail, we need your signature.

Absolutely report the agent to whichever company or companies her represents, file the issure with the commissioner of insurance, and call that agent, they will have to fix it, they have errors and omissions insurance for such an issue,but I'm willing to bet they would rather pay out of pocket to fix it legally and ethically than to make a claim.

They got insurance almost every type of issue and some times they will cover anything or the insurance company will get sued for something dumb.

I remember a story where a woman was suing a man and his insurance company because the man gave her a VD in his car.

They denied the claim, she sued and I don’t remember hearing if they settled or one side won.

Tell me you’ve never interacted with LAOMV in different words

They literally don’t answer the phone. If you don’t live close enough to drive in, you’re stuck. Possibly the single worst-run government agency in all the United States

The agent should make it right. All he has to do is give the DMV proof of when you canceled the previous policy and when the new one took effect. If it was 25 hours or more, you’re fricked but if it was done on the same day then there’s nothing to worry about.
