In schools, they teach kids to literally put their hands up to an aggressor because there is like a 1% chance of someone hitting a person with his hands up.

If someone would get in my face like they want to fight, my instinct would be to punch the frick out that person. If they aggressively come out you and get in your face, at that point they are a threat. But the next decision is the important decision. Depending on how that person reacts to your punch, what do you do? You have to assume that you pissed him off so as long as he isn't knocked out, do you make him have to chase you or do you just keep unloading until you feel like he isn't a threat?
My instinct would be, hit them before they hit me then stay with it because you are at least hurting them to the point, if they are able to get to you, they are not at 100%.
If they are bigger and badder than you, if you run, then if they catch you, you will be more burned out from running away than they are so it would be more difficult to defend.
So really it comes down to... Do you protect yourself and risk going to jail or take an arse whippin and not go to jail.

My philosophy on taking the first punch is if you're gonna do it, make sure it counts then do the "Michael corleone in the restaurant" which means you knock him senseless and turn and quickly walk out before anyone processes what just happened and has time to remember your face
