If someone is in your face, talking shite, threatening you, what should you do?

Let’s say you are in a bar and some dude is who is pissed at you, walks over to start a fight. He works out and knows how to fight because he is security forces. If you let him get first punch it make be over for you. Do you risk taking first punch and getting blamed for the fight or wait to let him take first punch?
A friend of mine just got charged with assault for decking a dude who walked up to him aggressively in a bar. It was caught on video. The JAG and ADC agreed he was the aggressor by taking the first punch, even though the other military member walked up to him and got in his face. The ADC plea-bargained a lesser sentence and bad conduct discharge over the incident.

The huge majority of us are able to avoid getting people fighting mad and/or avoid places with trashy people after the age of 25 or so
