Self defense

Don’t forget the crime, too.

Well we convicted for manslaughter which doesn’t have an intent to kill component.
I can’t speak to the judge’s rationale but the max is 40 with no parole if memory serves.

You’d have to talk to him about that.

quote:You don't need intent to kill. Intent to inflict great bodily harm is enough for 1st or 2nd degree murder. Ward is lucky he only got manslaughter.
How did you find an intent to kill
quote:Being drunk is never a defense.
someone who was seriously intoxicated
quote:It doesn't matter how the fight started, it matters how it ended. And it ended with a man on the ground getting kicked in the head. It's manslaughter with zero doubt.
and there is no evidence as to how the fight started?
quote:I think 40 years is the max.
Then, how does a judge give the max amount of years under those circumstances to someone with no criminal history?

Ward obviously hit and kicked the dead guy. There are only two possible reasons for this:
1. He just decided to attack a random homeless guy for no reason for the first time in his life
Or
2. The guy was rifling though his pocket and he thought he was likely to harm him.
Both are theoretically possible but I think most jurors in another city would believe it was the second reason
If Ward feared for his life, why didn't he report it? Did he still fear for his life after the guy was on the ground calling for help? At what point in the process of beating someone to death would an "average person" (that phrase is on the books) cool off and realize he's in no danger?
It is very likely that he was provoked, possibly by being pickpocketed. So no, I don't believe it was completely random, but if you are provoked and respond in a way that kills someone, that's manslaughter at minimum. That's just what the law says.

That’s a tough spot. Glad I wasn’t part of it.
I trust the jury got it right though.
But hard to know in Orleans.

Do you use antibacterial soap on your Antonio Banderas torso dildo, or just regular smell-good soap?

WD suit issue
I imagine Garrett used whatever available assets he had to go toward defense costs. Criminal defense retainers & fees to go through investigation & a 2nd degree murder trial would be pretty expensive, right?

Anyone know if he moved to a new prison or is he stop in OPP? I could not imagine what he’s thinking right now. Holiday’s must be so hard for the incarcerated

Legal costs were more than likely well into the six figures.

So even if you lose the case and get convicted it’s still that much? That’s got to be a sick feeling spending all that money and and did not help one bit!
