There was a mountain of circumstantial evidence and a whole lot of "coincidence". From a defense attorney perspective when you have that much against you you have to have a good alternate theory of the case and solid evidence that the alternate theory is correct.

Going from memory I remember feeling like there were some leads that didn't get the investigation they deserved. I do think he did it but I thought it was razor thin whether the prosecution met reasonable doubt. That being said when the vast majority of the evidence points to your client your alternate theory becomes the cornerstone of your defense whether you treat it as such or not.

Most people are not aware of the robbery that was happening directly across the street from their house at the time she went missing. How unlikely is there to be an unrelated murder across the street from an unrelated robbery at the same time?

Prisons all across this land of ours are filled with folks who were convicted on cases built of circumstantial evidence only. The law and jurisprudence very clearly allow for it. And no I'm not talking about news reporting as part of a circumstantial case, I mean the case put on by the government within the trial only.

That’s not the burden of proof for a criminal conviction. I never read or watched any5hing on the case. What physical evidence is there?

The place her body was found is about 90 miles away from the Peterson house in Modesto. There are many other bodies of water in between, not to mention all the land, forests and mountains within 90 miles of Modesto. It is curious Scott decided to go fishing 90 miles away on Christmas Eve and then her body is found where he was fishing. So either he said he was fishing there in order to give himself an alibi for being in the area or the "real" murderer dumped the bodies after finding out he was there. The odds of this being a coincidence are nanoscopic.

But again...why was he there? It's certainly not the closest place to fish from his home in Modesto. Why go that far to fish... on Christmas Eve, leaving your 8 month pregnant wife at home. If she went into labor, it's going to take at least 90 minutes to get home. He claims he was fishing for sturgeon. There are closer places to fish for sturgeon than where he went. A source does say that near the Richmond Bridge does have good sturgeon fishing....in March and April. The better places in the Bay for late December would be the south end of the bay. Many many many miles from where he went. And if I recall correctly, the weather in the area in 2002 at that time was not great. (I was in Fresno for Christmas and went to San Fran the day after- I remember seeing the flyers for Laci posted around town. I remember the weather being cold and overcast, typical SF weather).


All of this is a circumstantial case. There is no smoking gun in such a case. It is the totality of the evidence that leads to a verdict. As someone else said, he is either the unluckiest, dumbest guy around.... or a murderer.

If I could ever find out more about his fishing trip I would know for sure, but going fishing on windy rainy day in December on big open lake is bullshite, and I am hardcore but that’s just stupid
