How much do lawyers make on a winning case? What percent?

For instance, in a commercial a lady said Gordon got her 325k. Is that after Gordon gets his cut? If so, how much did Gordon make?

Get Gordon and get it done.

33-50% depending on complexity. + Fees
Posted on 8/17/25 at 1:24 pm to Cycledude
the typical contingency fee percentage ranges from 30% to 40% of the total recovery

325k could net the plaintiff very little. If there are comp liens or medical liens or if, God forbid, you’ve got to settle up a Medicaid lien, the plaintiff could end up with very little.
My guess is that the lawyers advertising these cut a deal: You do my commercial, and I’ll cut my fee.

Settlement=30%
Trial=40%
Appeal=40%
all plus expenses.

In the fine print at the bottom of the screen “Paid actor portrayal”. Take that for what it’s worth.

Keep in mind attorneys front the expenses (eg expert witness) and eat the cost if no recovery

That’s a good question and one of the reasons those ads ought to be banned. I assume it’s before the Big G took his 40% cut off the top.

I guess that is why the legislature pushed to require Medical bills to be at negotiated insurance rates instead of billed rates. So a broken bone that gets billed 50,000 but with medical insurance only gets billed 5,000 after using insurance billing. Before the hospital would try to get that 50,000, and that would be what the court would use as a baseline to decide damages, and then the hospital would negotiate that 50,000 with the attorney and get a lesser amount, and the attorney would pocket the rest of the money.

One odd feature is the medical lien. For example, there were $100k in medical bills that were incurred in some sort of lawsuit. That does not mean that $100k in cash traded hand to pay those bills. That is where the negotiation skills of the attorney come into play. Those medical bills can be lowered significantly.

Huh
Fee will be 1/3rd before suit and 40% after suit, plus cost and medical expenses.
Most plaintiffs will expect to get 35-40% of total. 30-35% if hard medicals are really high.

No the client would.

It’s fraudulent advertising. Many use paid actors and not the actual injured person!
The amount they brag about s the gross amount . The lawyer takes up to 30% and even more in some cases
Lawyers also get paid interest on loans that they give to their clients who are hurt and can’t or won’t work. They don’t mention that!
The plaintiff culture is hurting this country and making people soft victims.

Sometimes the medical bills get reduced after the settlement which goes to the benefit of the attorney

It’s way above 30%, not sure where y’all are getting that number. 33.33% is the lowest you will typically see and none of the TV lawyers are charging that. They are all 40% and above.

Normally 33 1/3 %
Med Mal 40%
