Who called the cops and when was that called placed?
It is best to not call the cops until after the fact to use them for the police report.

Fact of the matter is
Home owner shot and killed an intruder.
Shot fired drew attention of neighbors who called police.
Homeowner would have to have been mentally retarded to not think police were going to show up.
Homeowner continues to wield his firearm during police arrival and obviously after police make contact with him.
Homeowner (Holding a gun) gets shot by police responding to a disturbance call (in all likelihood shots fired call)
This ain't rocket science people. Tragic as it is, Dude would be alive today if he would have been a responsible firearm owner.

If I am in my home, in the dark.. having fired upon an officer that had not identified himself...
My defense would be exactly the same as what any "officer of the law" would be...
it was dark, chaotic and I was never warned or informed by the officer...
I would also make sure my defense attorney pulled previous law enforcement defense testimony that reflected similar circumstances when they were absolved of any wrong doing... and my argument/defense would simply by if it was good enough for the officers to not be punished in these circumstances then it should be good enough for me...

Had this conversation with a couple of neighbors who are LEO (one state one local) Both said in this type of case make sure you put your gun down before they arrive and they can clearly see your hands when they approach. Having the gun in your hand when they are responding to a shooting call is not good. I'm sure the old guy in this case wasn't thinking clearly and the cop who fired at him wasn't either.
