No, there are other options in that moment. You can throw down you weapon and raise your hands. You can scream and identify yourself. You don't have to either return fire or just die.

I tend to speak out when I see something wrong, not in every police shooting.

Feel free to draw your inferences there.

The next time you post something positive about the police would be the first time.

Serious question though - if a homeowner is fired upon by the police, does he have a right to defend himself? If this guy fires back at the officer who just tried to kill him mistakenly, does he have any defense in a court of law?

This happened at Ruby Ridge. The court ruled in favor of him, even had the same agency who had LEO killed give the shooter back his guns.

That said, you have to be alive to make it to court.

That’s assuming they haven’t already shot and killed you. If cops bust down the door and open fire, you’re likely dead and have no time to do what you’re proposing.

There’s a huge lack of details right here. Not so sure I want to jump to conclusions just yet.
I dont really need to jump to conclusions

Even what you posted as pro cop is a fricking awful look

Does this really need to be said? Obviously if you're already dead, you're not returning fire or anything else.

Then what are we even discussing here?

Uh you’re trying to say there’s an option other than return fire or die.

Unless you’re talking some hypothetical which doesn’t apply to this story, there doesn’t appear to be one with what little facts are out.

Really messed up.

As a homeowner/gun owner you're absolutely supposed to do exactly what grandpa did, but then again you have to worry about trigger happy cops killing you!

quote:

Police were responding to a report of a disturbance when they shot the armed man at his residence,

Quite reading after this.

Not trigger happy cops.

Idiot home owner.

Without reading the rest of the article I guarantee you the police didn't sneak into his house after he shot and killed the intruder. Dumb arse choose to continue handling a fire arm that LE were arriving on the a scene that they were unclear of who was who.

Once the threat is ended you secure your weapon and cooperate with LE to the best of your ability. And understand that you will be a suspect in a potential crime until they have assessed the scene.

Go back and reread slack's original hypothetical he asked me.

Okay he said

quote:

if a homeowner is fired upon by the police, does he have a right to defend himself?

You said it would be unwise and that’s when I replied to you. The other hypothetical where the cops are outside was never a part of our discussion.

So your very specific hypothetical is now if cops bust down your door and you happen to just be standing right there with a gun and they start shooting, do I shoot back or just die?

what kind of stupid question is that?

I am not sure why you get your panties in a twist over a post that you factually agree with me on.

We both agree that indictments are unlikely and a civil settlement is likely.

Well, to split hairs here, you wouldn't be arguing anything, you'd be dead. That is not to say that in your extremely rare hypothetical situation that I don't think the cops are in the wrong. Just the fact that what typically happens is not cops being reasonable and intent on listening to somebody that just shot another cop.

That's what in saying though - let's assume you had to shoot your way out of your own home. Let's act like you made it out.

Do I agree with that though? Without knowing any real details of this situation? There is a reason my reply to you was "speaking of jumping to conclusions..."

So the scenario is now that you absolutely have to shoot back to live? If the cops were wrongly shooting at you and you killed t hem ion the process, I'd hope that legally you would be cleared.
