HOME TITLE THEFT --- now what?

How common is this crime, actually?
I tuned in to the AM radio dial briefly this afternoon, and an ad came on for some product called "home title lock." The guy promoting "home title lock" stated that title theft is the fastest increasing crime in America, and that victims of this theft usually know nothing about the crime until cars, houses, property, etc are purchased with the victim's personal identity, and creditors are demanding/ suing for nonpayment, or the rightful homeowner is locked out of his home and/or the home has been acquired by the thief. What's worse, the advertisement went on to say that victims of home title theft have essentially no legal recourse.
Does anyone have information on this matter?

It probably happens once in a while but if something is being advertised on AM radio or late night cable it's designed to scare old people.

When you purchase with a mortgage, title insurance is required. It is a one-time premium payment at the closing, and covers false claims to a title.
The only people that should be concerned about it are cash purchasers that waived the title insurance coverage.

Title insurance wouldn't cover title theft but it would cover a subsequent buyer from the person attempting to steal and resell the property.
While this could happen if an amazing set of circumstances were to occur it is basically impossible for a huge number of reasons. It has happened and it may even be the fastest-growing financial crime in America, you know it happened once in 2022 and twice in 2023 so a 100% increase in a year.

Ok. But this isn’t what home title theft is.
Home title theft is real estate fraud where they provide fake documents and obtain the deed to your home. Then they take out mortgages/loans against the deeds that they illegally obtained.
Only on rare occasions do they try to actually sell the property out from under someone, and then normally it’s uninhabited land. If they tried to sell a home that someone is living in then their scam would be up, and they would be caught.
Now how common is it? It’s not common at all. And it can be fixed by the true property owner, although it may take them considerable time and money.
But those commercials selling “insurance” are made to scare people into buying something they don’t need.

I wouldn't go that far at first, but if it comes down to it. I don't understand some of these states. At least I live in Alabama where I can rightfully take action against someone in my property.

I don’t think it is common at all. Thieves aren’t usually the smartest folks and they are pretty lazy as well. There are a whole lot easier and faster ways to make 50 - 100K

I don’t know about the actual rates, but I have a buddy who underwrites title insurance and he told me their pay out range is effectively 0%. So basically, it either never happens, or the policy you buy is worthless.
