She could very well be sober enough to lead the accused to believe reasonably that she is consenting though, which is the issue.

What perplexes is that BF escorted accused rapist out? I can guarandamntee if someone is on my woman when I get home, an arse will be whipped at least.

Guys, come on, I'm positive it wasn't just a "okay buddy it's time to leave, let me walk you out." I'm thinking the boyfriend drug him out and put a few fists into his face. You think cops are going to arrest him for a assault for breaking up a rape of his gf?

Yeah, this case will be very interesting because law cannot fix every situation or find the truth about everything that happened.

The standard is Proof Beyond a Reasonable Doubt to convict the defendant of a crime. The victim admitted that she was VERY intoxicated. How does the prosecution prove beyond a reasonable doubt that an admittedly VERY intoxicated victim didn't provide some indication of consent? Prove a negative? Prove that she DIDN'T indicate consent at any time during her very drunken evening?

Very interesting.

I have read all the articles I could find on this. They all said he escorted him out. Where are you getting your info?

If it was a rape, the BF would have been holding him for police. She would have said Rape, help, or something.

While nothing seems to add up, we do not have all of the information that exists.

'Positive' might have been a bad word choice, but I am fairly certain that it wasn't "Hey buddy, you've had enough, come on, outside now."

I agree that nothing is conclusive with many of the details unknown.

If he was hammering her arse for 3 hours, off and on, it wouldn't matter if there was consent or not-- she likely looks like she was torn up from the get go, and hence, the rape kit is not going to do anything to help that guy.

But you can't give legal consent when you're drunk..especially like that.

Yep. If the BF comes home to a rape, he doesn't escort the perp out and doesn't scream at the GF.

I'll add some new information to this: the accused is the heir to the second largest Brazilian brewery (Schincariol Brewery, they also make soda, bottled water, etc), worth nearly 2 billion USD YEARLY.


This leaves 3 options:

1) It was a set-up in order to get some sweet $$$

2) It wasn't rape and she is using rape to justify her affair, in which case she is screwed because the dude can pay really expensive lawyers

3) It was actually rape and he'll get off easy because he can pay outrageously expensive lawyers
