Greg and Travis McMichaels - Could they get convicted on 2nd degree murder charges?

I think a strong argument can be made that simply taking the gun with them and having it in hand when they exited their vehicle constitute intent. I don’t think a conviction would be hard to win on that.
Thoughts OT?

1st isn’t even out of the question.
One called the other and said get your gun ima come pick you up. Then they had to drive around until they found the guy.
There was at least like 5 avoidable and out of the way actions taken that preceded the exit of the vehicle and murder.

There will be so much more to this.
The fact that he went from running on the left side of the road to cross the road and going to the right side of the truck and then suddenly fight a guy for the shotgun.
This will take a huge turn

quote:
a) A person commits the offense of murder when he unlawfully and with malice aforethought, either express or implied, causes the death of another human being. (b) Express malice is that deliberate intention unlawfully to take the life of another human being which is manifested by external circumstances capable of proof. Malice shall be implied where no considerable provocation appears and where all the circumstances of the killing show an abandoned and malignant heart. (c) A person commits the offense of murder when, in the commission of a felony, he or she causes the death of another human being irrespective of malice. (d) A person commits the offense of murder in the second degree when, in the commission of cruelty to children in the second degree, he or she causes the death of another human being irrespective of malice.
Under the Georgia homicide statute I can see it. Prosecutor should be able to hammer the implied malice intent.

I’ll let this play out in a court of law before I pass any judgement
It’s scary so many posters rush to judgement after only watching a minute video. I guess they know all the facts
Guilty until proven innocent around here which is very scary.

I don't care what they get charged with, as long as those redneck fricks go to jail for a long time.
