Is East Baton Rouge Parish a “Home Rule Parish”? Section 8 applies to Home Rule Parishes.
Yes.
quote:
The Plan of Government can be considered the City-Parish's "Home Rule Charter" or constitution. It was approved by the voters of the parish in 1947 and has been amended several times over the years. It details the composition and powers and duties of the Metropolitan Council, Mayor, and City Court, as well as several other essential functions of Government like the Finance Department, Public Works, Council Administrator-Treasurer, etc. It can only be amended by a vote of the people.

I'm in my late 50's and remember going with my Dad to Ben Peabody's Esso on Scenic Highway to buy duck hunting supplies. Most of the car dealerships were in, or near, NBR when I was a boy.
ETA: By definition, NBR is the area north of Choctaw, south of Scotlandville, east of the river, and west of Airline Highway. For some reason, folks consider anything north of Florida as NBR, but this isn't the case.

It’s refreshing to see that the St. George supporters are so well versed on the law. The Louisiana constitution clearly prevails if there is any conflict between it and a parish plan of government, local ordinance, or even state statute. Various efforts by those opposing St. George to manufacturer frivolous arguments are not going to get anywhere because we have a conservative First Circuit and Supreme Court that apply the Constitution as written and give meaning to its plain terms.

Also, the section of the State Constitution concerning Plans of government not being able to limit the incorporation was part of the original 1974 language, where as the City-Parish Plan of Gov't was amended October 20, 2007 to change to language restricting the incorporation of municipalities.

Why would the parish attorney and EBR”s outside legal counsel allow an amendment to be voted on by the parish’s voters if it is clearly unconstitutional?
Posted on 10/8/19 at 12:02 am to LSURussian
Not sure, but plainly is it unconstitutional
Posted on 10/8/19 at 12:15 am to LSURussian
My best guess is that was viewed as more of a zoning/land use issue that did not undergo a constitutional analysis. In any event, the constitution is clear

quote:I agree. But there must be more to it than what is obtained by a five minute Google search. If an amendment to the plan of government wasn’t vetted for constitutional compliance before being presented to voters there are some attorneys who should be sanctioned for gross incompetence.
plainly is it unconstitutional

Because white folks did it!
Wait! What exactly happened?
Doesn’t matter, white folks did it

So, let me get this straight.
If you take the white folks out of the parish, then what excuse possible do they have to say that white folks are an issue?

I wonder what it’s like to be so convinced of something and yet be so wrong. I wonder what it’s like to have been lied to your whole life, such that you have these preconceived notions about others, these biased assumptions—to be so ignorant but convinced about others, and to be so narrow minded and prejudiced.
The life of a snowflake is one of deceit—whether intentional or otherwise—dishonesty, and hate/intolerance.

Why does Gravy care who lives where when he is still living with his parents? What economic blight is he speaking of? How would he know? Go work at Amazon or Lyft, ya big biscuit.

Because their goal is not the law or what's "right". Their goal is to delay and hamstring the effort enough so: a) they can continue to squeeze tax money out if it; and, b) that it is crippled from the start and the will be able to grow about how shitty it is.

Because white folks will take their money with them.
They don’t want white folks interfering with Wakanda but they sure what white people’s money to fund it.

Some advice for north Baton Rouge:
- Be less tolerant of corruption.
- Patronize local businesses
- Report crime to police
- Keep your kids in school

At the end of the day, the man just isn’t very smart. He probably has a sub-90 IQ. I don’t hate him for that but the people around him have done a grave injustice to him by allowing his message(s) to be front and center.
