If you decide to hire cheap, untrained, and dangerous Mexican trucking companies and drivers; then you should pay a VERY high price when accidents occur.

If you’re hiring a legal company, how is it your fault if they screw up? If I ship something, I’m supposed to audit the company and check to see if their driver is trained and has a clean driving record?

Edit: I didn’t see where it said “brokers”. That’s a little different, I guess.

As a contractor, I can't hire a shitty sub to do work, then not expect to get sued when their work is crap

I'm not saying they should be. But until today they were shielded.

No but if I was, I would use this to generate business. Claiming that I can handle your freight bookings and make sure reliable companies are used. It’s a gold mine ruling for freight brokers.

They are a broker taking money off of the transaction. You can't expect them to have all of the upside and zero of the downside. That's not how it works.


I also sell on Amazon and Amazon makes sellers carry insurance just for this very reason. If I sell something on Amazon that causes damage, the person isn't going to sue just me. They are suing Amazon, too. Amazon takes 15% of every transaction so they are in essence, a broker, but they have liability in making sure the products sold comply with laws and do not cause harm.

I also sell on Walmart.com, and they do require the same.

Speaking of Walmart, they can get sued for the products manufacturers sell in their stores.

There are many more examples I can come up with.

I see it as the opposite

I think it's a nightmare for them. They just sling loads onto their apps and anyone can grab it as it stands now so it was a race to the bottom, according to a few independent truckers who deliver to me.

Now the ball is in the court of legal and safe truckers. Either freight will have to go up or brokers will have to take less of a cut because they have fewer options to choose from.

It also aligns with the ruling they made in Geo Group v. Menocal back in February that said Geo Group can't claim derivative sovereign immunity from law suits. That one was also 9-0.

Finally. They've been skirting liability for decades by claiming "I'm just a broker" while controlling most aspects of the arrangement and otherwise being insulated from having to give AF.

Have seen far too many Mexican drivers immediately never return to the US and the broker say "so what?"
