That was my question, but it now sounds like the bank itself requires a license to protect it's investment in the home. That's an entirely different issue. The question becomes can the bank exercise a policy to require a license to ensure proper repairs on a home on which it holds the mortgage and in doing so, can the bank withhold the funds?

I thought it was a good interview. Dealing with banks are a PITA. Can their bank policy to require a contractor override the law? Like, that's a min standard and they require more? I know some banks won't loan for a build to self contractors.

And this is how his "buddy" loses his license and thus his livelihood. I have many building construction licenses in quite a few states and I've been asked many times over the years (including recently regarding this flood) to loan or rent one for various projects and it never ceases to amaze me that people actually think I would accept this. Never would I jeopardize my family or livelihood and business that I have worked for 35 years to build. Cretin has been in business a long time and I've known Eddie for 15 or so years and I can't imagine he would do this as well.
And Cretin would not be issued a 1099. They might be asked by the bank to provide a W-9 but then again they might not. Regardless if the bank wrote them a check and they in turn wrote you a check they would be required to show it as income, pay tax, general liability insurance and unless you take it as a paycheck they would have to pay the workers comp insurance on the amount written to you.
I wish you luck and keep arguing but I'll make a suggestion. If you are in the business and will continue to be I'd say you should go take the test, pay the fee and get your own license if for no other reason than to have for a situation like this.

I disagree with some of this. If I recall, Chase will actually cut the check to the customer. Many banks do that. I assume they just want a contract. I also don't think permits or inspections are required for these remodels. Franktown doesn't need to go get a contractors license. Mr. Eddie is ptobably the only one in the whole business who has one. The LLC only needs one license. This dude doesn't need to carry insurance and such just to have a license in his back pocket. I've also known Mr. Eddie and Mo for years, and they take care of their people when they need something. I imagine this is more about taking a stand and making a point to the bank then being able to find a solution.
