Not sure about other states with community property but in Louisiana you can opt out. Sure it isn’t justice, but to be fair you had the opportunity to opt out.
The retirement accounts issue seem to be the problem with marrying 12 years younger than you. Half of your retirement at 50 is an unfair portion to give to someone at 38 who probably has half as much saved up. That’s the nature of community property, 50/50 with no regard as to who put it there in the first place.

It sucks man. Could’ve should’ve isn’t going to help here. Get a good lawyer And segregate what you had going in, bc it’s possible. It’s a cry once or cry every day situation. Be a good dad. The law is what it is and she’s working the system. Similar to the people who took the covid money and never missed a day bc they fit into an income range but those outside the range who were let go didn’t get shite. If you made it once you’ll make it again. She may be the reason you didn’t have more. Pussy is undefeated

Money wise that sucks, but holding a grudge will make it look even more like she has won. The kids are still a very important part of your life. Unless she really put you in the poor house then you should be able to lead a pretty good life. Sorry though. Women can really screw you without thinking twice. Best of luck.

Sounds similar to how the divorce with my younger ex went. At first she said she didn’t want anything she didn’t earn but I guess she forgot to tell her lawyer. She used access to the kids as a bargaining chip. Just keep telling yourself you’re making sacrifices for the sake of the kids and they’ll benefit from the money (ha!). My ex panicked a couple of years after our divorce because she thought she’d never be able to retire so she moved into a tiny apartment. The kids weren’t having it so they stay with me full time.

When I hear of people complaining about divorce, I know they didn't get a pre-nup. My wife and I do a post nup when there are major changes in our lives and we need to protect ourselves.
There's the relationship (emotions) and marriage (legal contract). If you can't deal with both sides of the coin, don't whine about it.

Seriously, man I am sorry you have to go through this. Hang in as tough as you can. I think once you make it through this crucible you will see you are better off without her. Good luck brother
