He's a huge scumbag for sure and should face the legal consequences for it.

That and probably in some states due to the age of consent. In some states it is 17 or 16, but Florida is 18.

In those states where the age of consent is 17, unless it was rape, the only crime they could charge would be the law that forbids sexual contact between an educator and student.

That usually results in a serious enough of a charge to lose their teaching credentials and black list them from the education system.

Most would probably avoid jail time since that is a misdemeanor in some jurisdictions instead of a felony.

Also, with second chance laws, some can petition the court to get the charge expunged after a few years. Once the charge is expunged, some may even petition the state teacher licensing board to return to education.

A school district would be stupid to hire them or put them with younger students. The other aspect is whether it is a male teacher or a female teacher. A female teacher could receive a lighter punishment than a male teacher in similar circumstances.

Just looked it up and age of consent in Florida is 18. So this all legally is true. What many people don't realize is that more states set age of consent at 16 or 17 than states that have it at 18. What most of these teachers are getting in trouble for is the fact that they are in a position of influence/power over the student. The actual age for Louisiana for instance is 17. So if he was just some guy, this is completely legal. Definitely not right, but I think it's strange that everyone just assumes it 18 as the cutoff, when more times than not, it's lower.

Just remember that ignorance is no defense. Sixteen will get you twenty. It doesn’t matter that she looks 30 and has and ID that says she is 21.

None of this addresses the "abuse" part.


I'm not saying this dude shouldn't be punished, but calling it sexual "abuse" is deceptive and wrong. As for her age, it says she was 17, not 16.

I assumed she was 17 at the time of arrest. She could've still been 16 over the winter break when this affair began.
