The gas station bottles are clearly labeled for anyone who knows what the words and percentages mean. But for those who don't, it's probably misleading.
Not sure what the damages could be though, if the claims is that you were too fricked to read the label but didn't get as fricked up as you were hoping.
But the "real" whisky is nasty enough that I've never been tempted to find out what the gas station version tastes like.

Yeah, the fact that gas stations in Texas can't sell liquor is the only reason I was curious enough to read the label while standing line with my high class Lone Star.

I have a relative who sells hard liquor. He says that in the hood, the customers often come in and buy the small whiskey bottles 4-5 times in one day (instead of buying one bottle of equal quantity). So, they lose the price break for a single, larger quantity.

They get around that by having a separate entrance to the “liquor side” of the store. I know of two gas stations within 10 miles of my house they sell liquor this way.

Possibly. I’m sure there is case law on this. It just seems to me Fireball intended for people to think it was the same thing, otherwise they would have re-worked the bottle and label. I don’t know how or if that matters in this case though. Seems it would.
It’d be like Coca Cola putting Diet Coke in a regular Coke can buy slapping “Diet” somewhere in the fine print.

I think people are missing the point. There are two different versions of the mini Fireballs. One is malt Liquor and one contains whiskey.

Exactly, in most other states you can’t buy liquor at a gas station, so it’s a non starter. In those states, they sell these reduced 16.5% “fireballs” at the gas stations for the bums to latch onto.
Fireball sold at a package store is the real deal normal stuff.

I don't like to take shots very often. I only want to drink to enjoy the beverage and shots just seem to get you to the end of the road without enjoying the journey. Occasionally though, when golfing with some friends, they insist on a Fireball shot. I will usually ask them to get me a shot of Tito's if I'm going to have to shoot something. I had my fair share of Fireball and Goldschlager binges back in college.

I was at a local regional grocery store not long ago and I saw they had a bucket of these tiny bottles like those buckets of double bubble that you would bring to the ballpark to play baseball, and they had about 200 little bottles in there for $17, and I considered getting it and bringing it to a tailgate, but just stuck with my traditional whiskey of choice

This, it’s clearly deceptive because it’s virtually the same packaging and even says the word whisky on it. Further, they sell regular fireball in the same small bottles.
Why else would they make no effort to alter the packaging if not to deceive?
