Food & Wine reports that the news was uncovered due to a class-action lawsuit filed by Anna Marquez. The lawsuit, which was filed against Sazerac Company, Inc. (the makers of Fireball), calls out the company for misleading customers with their labeling.

I can honestly say I’ve never once tried Fireball. Doesn’t appeal to me at all. I’ll stick with bourbon.

If the label says it’s malt liquor, I don’t see how the suit has a leg to stand on. Am I taking crazy pills here or what?

So it does actually contain whiskey or some kind of alcohol, otherwise that percentage would be 0...am I reading that right?

its a malt beverage, so it is brewed like beer and not distilled like whiskey.

I see these when I stop for a 24 oz High Life. Always curious who would buy the little bottles of hooch. They wouldn't last a mile...

I don’t know if this matter in the legal sense, but the bottles and labels look exactly the same. It seems to me they made them with the intention of people thinking they were the same.

I knew they were different because gas stations here in Alabama can’t sell liquor.
