It won't have to be. An 8-10 inch gap is going to be fully shaded 95% of the day. Nothing will grow except at the extreme ends of the gap. And a little roundup will easily fix that. A 2-3 foot gap would be an entirely different issue.

You do not need to give the neighbor permission to enter your property for any reason to repair or maintain the fence, or to keep the grass mowed. If the neighbor is a dick and you want to be a dick too, don't mow the 8" strip but rather complain to the HOA. You won't be compelled to maintain someone else's property. Your neighbor may be counting on you to keep mowed that 8" strip.
Be nice and ask the neighbor if you can pretty please tie into his fence. If he says 'no', then ask him how he plans to keep mowed his 8" strip. If you can tie into his fence in return for you keeping his 8" mowed, problem solved. There's more to worry about in life.

Put a chain link on the side that faces his. That way the grass grows crazy and he has to maintain it. His is privacy there already. You won't have to see him unless he on a ladder reaching over to cut that gap with something lol

The OP has said a few times that he does not have a HOA. Are you thinking he is wrong?
I like the idea of cantilevering your perpendicular fence to within an inch of the neighbors. Or talking to him and working out some kind of deal with maintaining his small strip of property.

See, there are laws on property boundaries and the establishment of them. The fact he took it 8 inches back without working together with you first is really stupid. Not knowing exact details, it's likely he truly just shrunk his own property legally. Good for you and dumb of him.

Offer to pay for half of that part of the fence. If that doesn't work proceed to build your fence on your property line and don't worry about his 8 inches.

He can't tie into the fence. Most people build a fence for 3 reasons. Pet containment ,to legally have a pool, and/or security. He now has to pay to have a 4th side instead of just tying in to the neighbors. Under no circumstance can he take advantage of that fence being there.
If the OP was thinking about putting up a fence only for privacy and to serve as a buffer between the 2 properties he would only have been concerned about that one side and what the neighbor did would have been seen as an unsolicited favor. His concern is that he can't tie in which means he wants a fence to serve as more than just a privacy buffer at some point. The money to build an extra side is negligible and not the problem for the OP. I am sure he planned on paying for it anyway. The dilemma he has is that there will be a strip of terrain that is inaccessible to maintain and will become unsightly.
There are a few ways to resolve this but I am not writing another novel on common sense.

Fence should be on property line. Problem will be that tress will grow in between on his property and damage your fence.
Send him certified letter. State you are building fence on property line as it should be; however it is his responsibility to maintain his property.
State you expect him to maintain his property and if it becomes overgrown and damages your fence that he will be responsible for the damage.
Anything on the line you can cut. Anything on his property you cannot legally touch.

Op didn't move to an HOA so he is fricked on that end.
I would build a bigger better fence right on the line and if he sprays the gap and it kills any of my grass I'd make him pay for it to be a dick.

The neighbor seems to be the issue more so than the op.

They could have combined cost and probably got a better fence out of the deal.
Since op has a dog and neighbor does to I don't think the invisible shock fence works. It leaves op dog at a disadvantage because of neighbors dog got out it could attack him.
IMO he should try the nice route but if it doesn't work out then as much as the law allows be a dick to him. You can only work with idiots to a certain point.

One very logical reason to do this, is because the guy had a property line issue in the past. So he went extra conservative and made sure his fence was on his side. I've heard of some jackass neighbors with property line issues, so I can see if someone had an issue previously how they could want to ensure they don't in the future by building their own fence well within their lines.
