Future earning potential does come into play. Unmarried/ no kids college student's lives usually do not put huge numbers "on the board". But a 34 yo surgeon with a wife and 3 kids who loses the use of his hands as a result of a tortious act of another tends to put large numbers on the board. This verdict however was mainly a pyrrhic victory unless there are other defendants besides Pugu. I assume the local laws allow for punitive damages where a DUI was involved because that is the only way a reasonable jury could get to that number.

Absolutely, that's where you need a reputable Vocational Expert and Economist to document the plaintiff's employment history, career earnings, future wage-earning potential, and U.S. Bureau of Labor Statistics. I'm a VE and have done thousands of reports in the last 25 yrs for both the defense and plaintiff sides. A 1st year Veterinarian in Bryan/CS will usually start out earning approximately $50,000 per year ($24.00 per hour). A Vet with 16 - 24 yrs experience will earn from $165,000 to $200,000+ per year ($79.00 to $96.00 per hour) depending on the practice, location, and animal volume.
Most people work to age 66. Not that difficult to project future career earnings based on the plaintiff's occupation, tax returns, and geographic area of residence. Life Care Plans are a whole different animal and usually where most of the monetary award is given to an accident survivor in order to cover future medical costs. Since IANAL (I am not a lawyer), I have zero clue on pain & suffering judgements.

It had to be the mixture of coke and the benzo. More so the benzo. Coke effects don’t last that long. Also depends on when he took it.

There is no insurance company holding into their policy limits in a case like this. Not the limits this guy likely had. So basically going through a whole civil trial to get a judgement that will never be paid when he faced criminal charges.

That’s just the wrongful death part. You also have the survival action which can let a jury award pain and suffering of the deceased and other damages. In situations where the deceased suffered a painful and protracted death this number is usually enormous and can be more than the damages for the wrongful death action.

Agreed. However, it wouldn't have mattered here...the guilty driver was born in the US (not everyone with a Hispanic surname is an illegal immigrant).
