Motorcycle definitely. The car did not move from his lane.

In California motorcycles have all right of way. Closest I ever came to killing someone was on the 405 south of LA. 100% motorcyclists fault but the fault would have fallen on me.

I see the benefits of lane splitting, but if you are doing it in a Harley with hards saddle bags, you are an idiot. Way too wide.

Not true. There are strict guidelines on the motorcyclist to adhere too like you cant go over 10mph more than the flow of traffic, can only split when the flow is under 30mph, etc.
Cars are liable when they attempt to block the motorcycle like open doors or swerving onto the line.
I'm sure this accident would either be no fault or the motorcyclist. The cars did nothing wrong. He missed judged his space and should have slowed down until the vehicles saw him and made room. They do have to do that once he is noticeable.

Totally agree. I've been on motorcycles for 52 years now and have put a few hundred thousand miles on them in that time and would never lane split with my fully dressed cruiser.
The very nature of riding a motorcycle on roadways automatically puts the rider in a more dangerous situation than the folks in autos.
That is a recipe for disaster and in most cases it is the motorcycle riders fault if an accident occurs.

That looked intentional. Was the fail that he didn't get enough speed to pick up the other 2?
