Yes, but that aggravation has to be caused by something. Maybe I shouldn't have used the word "aggravation" in my previous post.
There has to be an occurrence. Something has to happen. The article doesn't go into any detail at all as to if there was a real injury or not. Simply stating that your job aggravated your carpal tunnel, and filing for benefits, is pretty shitty. Especially if your employer is already covering part of your employee benefits, which Ia assume as a GM, they were.

have you read the article? this isnt so cut and dry. Its actually quite fricking ridic and the lawyer is asking for 10 mil, doesnt mean she will get it.

you're not necessarily wrong. I am not either. We don't know if she had an actual injury because the article doesn't say. It simply refers to her "injured wrist". Maybe she fell. Or maybe she filed a bullshite repetitive motion claim. We don't know.

I had to control F the frick out of it to make sure I wasn't missing something. Which I wasn't. They just give no background. I'd love to know what her injury claim was.
Don't get me wrong, if you hire someone with carpal tunnel, you better have some ergonomic training in place and have said employee utilize that shite quarterly. Otherwise, this is bound to happen.

it's a pretty gray area, but necessary. The issue isn't with the law. If a company has an unsafe workplace, and it causes someone pre existing condition to worsen, they deserve benefits. The issue is that this is pretty easy to bullshite your way through.

I had a lady file a claim that she developed it on the job. She kept trying to work and do shite so she could get further injured and take off. She was always looking to game the system. We put her as a door greeter based on the doctor's word on what she could do.
