Depends who you ask.
EPA emission regulations are the 2nd most stringent in the world behind California.
If the whole world were on the same page it would be debatable if they were valid or not. It takes a lot of extra diesel to make it, but they're clean engines. Factor in that you have to produce extra diesel and a whole lot more urea than we ever have and the advantages get more hazy. EPA only cares about the tailpipe and not what happens before the tailpipe.
With China having an industrial revolution, EPA is literally pissing in the ocean with regulation on things like 2 liter diesel car engines.

I think the under addressed point on this is how cheating allowed VW to gain a pretty massive competitive advantage over other manufacturers.

I wonder if the EPA will start checking emission levels of other small diesels at different conditions to determine if they have monkeyed with their controllers as well.

The nimble dicks who work at EPA couldn't find their own asses in the dark with their own hands.
This was quite a secret to have been kept for a long time. I'm surprised it was kept that long.

Emission controls kicked in when there was no tire movement or something like that. So parked an idling allowed it to overcome the test.

It can't.
Best I can tell it monitors wheel speed and ambient air pressure to determine if it's in a test cell or not. They aren't tested in a wind tunnel so if it's got an ambient pressure sensor at the front of the car and the rear it can decide if it's actually moving or if it's stationary on a conveyor belt/dyno drum.

That's what I thought, but every "news" outlet is reporting that it is emissions test specific

I'm going to wait a month or two then pickup a tdi on the cheap. Get the recall done. Then get a an aftermarket chip to put the car back to normal.

It's definitely test specific. It would take some pretty complex programming to do it but there are a million sensors on that car so it's definitely doable.

I'm reading your best bet for full compensation is to opt out of the class-action lawsuits and sue individually/in small groups in your county.

That's all good for the initial EPA tests, but what about when you get an inspection and they check emissions there?

I'm hoping it doesn't come to a suit and it's more of a claim type thing. Lawsuits are a huge drawn out pain. I'm almost okay with them just giving me the difference between the new shite value thats around the corner and current blue book value (pre dieselgate) .
