April 14, 2016

ORLEANS PARISH SOBRIETY CHECKPOINT

NEW ORLEANS – The NOPD Traffic Division will conduct a sobriety checkpoint beginning at 9 p.m. on Thursday, April 14, 2016 to Friday, April 15, 2016 at 5 a.m. Motorists will experience minimal delays and should have the proper documentation available if requested, i.e., proof of insurance, driver’s license, etc.

I went through one a wile back and the cop said my eyes were 'jumping around" but I blew .000 So I didn't get that. "eyes jumping around??"

Is that a new thing? Like made me follow a light with my eyes.

I always thought that was a BS test. No ticket, but he made me call a ride home. Thought that was BS.

Hadn't drank or smoked or anything that day.

FST results are what the officer wants them to be. That's why you shouldn't do them if you're actually DWI

It's not new. It's based in science:

"The Horizontal Gaze Nystagmus (HGN) Test.

You've seen this test in movies and public service announcements. It's the one where the officer has you watch a moving a pen or a flashlight. Nystagmus is an involuntary shaking of the eyes that usually only occurs at the extremes of your periphery. But when a person is intoxicated, it can occur at less steep angles.

So the officer will have your eyes follow the object, slowly, back and forth. He or she will be watching for jerkiness in the way your eyes track the object, looking for that telltale shake when they're off at the sides. If nystagmus occurs within 45 degrees of center, you could be in trouble. A person without nystagmus should be able to follow the object smoothly, and when they look at a still object at 45 degrees, they should be able to do so steadily."

He's probably fishing I'm sure, but I spoke with a BRPD DWI task force acquaintance who told me the eye test was their number one indicator.

My right eye twitches a lot. Like right now I can feel it sorta twitching. It's like a condition. I keep fearing it's going to go all Lil Jon on me. So I will decline this test in the future. I hadn't done anything at all that day. I was demanding the cop draw my blood and all.

Messed up my night, I was on the way to get lit, but wasn't lit yet

I can think of one high profile case from the past week where a checkpoint could have possibly prevented a murder.

I had something similar several years back. Was out on the river with friends all day with some friends. I was the DD because I had a game that afternoon and did not want to drink anything. Dumbass flagged a cop around to tell him I was drinking because everyone was passing him to the right. Cop did the eye test and said my eyes were jumping and he could tell I was drinking but I wouldn't be over the limit. Told me to slow down and sent me on my way.

Wasn't going to argue because everyone else in the vehicle was drunk as F. But, wouldn't chronic dry eyes (especially if you wear contacts) invalidate that test?

I didn't know that's what they were testing for with the flashlight. I have occasional bouts of BPPM, an inner ear problem that causes the eye twitching too. Guess I'll have to worry about getting DWI now.
