How old is she? I think I would tell her you need to save up to replace it and when, in a year or two, you get the scratch together you will be glad to talk if she is still around.

The only mistake I see is you should have put the offer to cut the tree down in writing. That way they don't have a leg to stand on 9 years later when the tree actually feel.
