Anybody who gets a DUI after taking a breathalyzer should be heavily punished. Anyone who is charged with a DUI based of field sobriety tests, erratic behavior or the feelings of a cop should be handed a couple of million dollars in punitive damages until the state stops doing that stupid shite. Breathalyzers work and are quantifiable, being able to touch your nose or some parlor trick is no way for the state to behave. It has become the norm and data suggests somewhere between 30 and 60% of those charged and fined with DUI based on standing on one leg and reciting the alphabet backwards was not legally intoxicated when stopped. Those tests account for about half of DUIs in the US every year.

You’re not wrong. Especially now with Uber and Lyft and all of that. I will say back in the day taxis and cabs weren’t readily available where I grew up but you could always phone a friend and as long as you’d return the favor they’d come get you

100% agree. Cops are not educated or intelligent enough to make subjective decisions. Most I know are some of the dumbest people alive

Most people can't, that's the point I think. People need to realize that the police are a necessary evil....and equally so. They are not in the business to be friends and win hearts and minds, they are in the business of making arrests because that's what we appraise their performance by. I will guarantee you if you ask most Americans what happens when the police suspect you of DUI they are going to say something about a breathalyzer being utilized. The fact is it may or may not be....it may simply be the cop asking you to close your eyes, stretch out your arms and bend them at the elbow and touch your nose....and no matter where you touch yourself you are charged with DUI. It happens all the time all over the country. It does not improve safety one bit but it does cause citizens a lot of problems and costs them a pile of money...it ought to be treated as an egregious over reach and victims should be awarded piles of punitive damages until the public insists it stops.

I have known 2 people in 60 years who can say the alphabet backwards. One of them is a bad drunk and the other one was a bad drunk and a drug addict. I seriously doubt if most cops could tell if you did it backwards. In any case it should not be anything more than a parlor trick...it is subjective and criminal charges should avoid subjectivity as much as possible.

The good thing is they are not mandatory and other than being given a ration of shite and a breathalyzer nothing will come of you simply refusing to comply. It is not a lawful order...it is a request that you can choose to comply with or not...and you should always not comply because the only thing that can happen that has not already happened is you being charged with DUI....

Of course the comply or die crowd will disagree because they can't imagine the state being corrupt or incompetent when it comes to arresting people and ruining lives....

Had a number of cops tell me they target people that can afford of the fees associated with a DWI. Does the county no good to arrest someone that can’t afford the fees associated with it. Very rare do you see cops parked across the street of a low end dive bar vs a bar that has a higher clientele in terms of $$
