Had a friend who was a cop. He generally gave everyone a pass. He would follow them home. He would tell them that the next time he pulled them over they had the option of their wife coming to pick them up or bring them to jail. He said he didn’t have a bunch of repeat offenders but most would rather go to jail than have the wife come deal with them.

If a person is too tired to drive, they should not. If there were a simple way to test for that, I'd be all for doing the checking for that as well. Most people who drive tired do so related to work demands. I would think most people view that as a little different than a person who decides to go out and get sloppy drunk and then drive. I would. She’s no better than a drunk driver imo. It’s just as deadly and just as trashy imo.

The reason is not irrelevant. Sleeping drivers are knowingly making a choice to drive while impaired. Your loved one died as a result.

This is like saying ‘they shouldn’t have drank’ or ‘they could’ve called someone’ and excusing actual drunk drivers.

The number is not irrelevant. Distracted by kids drivers are knowingly making a choice to drive while impaired. Your friend died as a result.

Apparently not. Different counties have different rules. This is his 2nd. He got one 31 years ago.

I don’t think anyone here is claiming there aren’t more DWI related deaths vs texting. I am just saying the penalty should be the EXACT same thing for those two offenses

Had a former coworker get pulled over and was given the sobriety test. He "failed" but demanded a breathalyzer test and had all 0.00. He had worked several 20 hour shifts in a row and was going to a hotel to shower and get a few hours of sleep. Cop was going to charge him with impaired driving but decided not to since he was already in the hotel parking lot and was in his uniform.

Most places don't count it as a second after some time, 10 years in Louisiana, I believe. But laws vary greatly by state.

It’s definitely more than that. It’s just not easily identified or proven to be the cause in most cases.

No one is saying it. I was in a bad wreck 11 years ago when A guy hit me going 70 mph when I was stopped at a red light. Been through 2 back surgeries and years of getting over it. I can’t do shite like I could before the accident. Guy wasn’t paying attention.
My great grandmother was killed by a drunk driver on Christmas Eve 1986. The guy served 6 months in parish prison.
He pulled out in front of her and hit her head on. He walked away. If I would have been a bit older I probably would have killed him myself.

You will lose your CDL over a DUI but there 2 sitting Louisiana state legislators who got charged with DUI and other crimes and are still in office.
