These kids were probably doing dumb kid shite on the road. The parents of the kid are more to blame for their kid being out in the rain at 1 in the morning that some lady for for driving 5 over the limit.
And it sounds like it was KM so wtf were kids doing on an 80MPH road in the rain? I mean come on. The lady was trying to get home and probably had tunnel vision (wonder how hard it was actually raining?) and some kid in dark clothes with no reflector on a bike tries to come across an 80MPH road. The kid also would clearly be able to see her better than she him unless it was a curvy or hilly road.

It was an 80km/h road. Your conversions are way off regardless. I agree with the rest of your stuff.

Yep, as I said earlier it was a 50mph road. No bikes have any business on that much less 3 kids riding in the middle of it.

I have no dog in this hunt, other than to point out that there's still more being left out. It was discussed in the other thread, but I don't have a link; the drivers husband is an officer in the department and was following close behind her. After the crash, he was never included as a witness, she was never given any type of sobriety test, and left quickly in his car after no questioning. This is the basis for the parents' suit.

What if the kids had just snorted lines of coke off of the middle of the road? What if she just left church? What if she didn't see them because she was tying off her arm to shoot heroin?
Yes, a BAC test should have been administered. I don't think anyone is arguing that.
BUT, it wasn't. And all they have to go off of is what is known for sure. What if's don't mean a damned thing.

So you don't believe there should be any investigation into the circumstances surrounding her leaving the scene and the police department's obvious conflict of interest?

Ya i guess I would need to know who sued first. If someone sued me for being drunk and texting and I wasn't I would be pissed and might sue them back for whatever I could. If she initiated the lawsuits though she is a POS.

Possibly. I don't know all of the details but I'll admit it looks suspect from where I'm sitting. Regardless of what your investigation would find out it won't prove her to be at fault at this late stage.

My initial reaction was much like most of the people's on here, but then I thought about it some more.
We need more specifics on the details obviously, but I could totally see suing these kids and their estates and their parents. The amount of emotional trauma that killing a kid would do to you is probably indescribable and we have no idea what these kids were doing on their bikes, what time of day it was, etc.
All I can say is this:
There was one day, when I was riding in my mom's car, an SUV at the time, I believe, in my neighborhood. The road goes up a hill and a kid was riding a skateboard on his back like a luge. And this crazy shite purposefully road his skateboard under my mom's car. She, of course, slammed on her brakes and thank God she didn't turn the wheel any other direction because he came out the other side unscathed, but my mom damn near lost her mind. She berated the kid for a while before getting back in the car and taking me home, visibly shaking.
Now if she had run over that idiot, the news story would read: "Woman kills thirteen year old skateboarder." But the reality is that the thirteen year old pretty much killed himself. And I would 100% support my mom suing the bajesus out of that kid, his estate, and his parents, because she probably would never have recovered from that. So, before we go saying that this woman should die a horrible death, let's remember that there are always 2 sides.
