Tesla autopilot doesn't replace the driver. It helps a bunch, but you do still have to keep an eye on things.

Yeah dont think there is much precedent for this. Would have to be more than just a "good" lawyer.

Tesla needs to come out condoning this behaviour. Then Elon Musk needs to get this guy the best lawyer around to see if he can get this in his favor for the future. What this guy did is the future "marketing" for autopilot, so it would be best long term for musk to make sure it's not a future road block.

Currently, you have to have your hand on the steering wheel occasionally giving it some movement or the car assumes you have fallen asleep and it will jar you back awake and lock you out of the autopilot mode for a hours.

Full autopilot is a coming programming download but the system has not solved the red problem in telling the difference between red lights and red brake lights.

Also, red lights are positioned all over the place in various intersections. So reading those in all situations is still a work in progress. Along with knowing if a right on red can be made and the turn signal arrows for turns allowed with or without it.

But it’s getting there.

Tesla auto-pilot isn't going to get the guy all the way to his destination so he still deserves a DUI.

Why was the car pulled over though? Tesla auto pilot lets you speed?

Because they saw him passed out in the car passing by

He probably could have gotten home if they didn't just happen to see him

Knew a guy who had this happen. He had pulled into a parking lot and went to sleep because he thought better of driving.

Knew another guy who also got a DUI in a parked vehicle but keys were out of the ignition and officer noted it in his report. Attorney got it knocked down to careless operation.

In most states an intoxicated person cannot legally be in the driver seat at all. The car could be shutoff upside down or completely underwater and it is still a crime.

Yeah, this isn’t a .09BAC money grab... a car that can help you stay in your lane isn’t gonna make driving safe when you’re that drunk.

I think the limit is too low, but if you’re passing out you’re wayyyy over any reasonable BAC.

Should have had the windows tinted. Obviously the car was driving the speed limit and not swerving. They must have just happened to see him passed out to pull him over. He shouldn’t have been in that situation, but probable cause is sketchy there at best. What if he was Asian, their eyes always look closed.....

Which is incredibly stupid and liberal application of DUI laws. Or just bad DUI laws.

What if you live in your fricking car? You can't ever get drunk at home? What if you're drunk in an RV and youre running the motor to top off the battery or keep the air condition on?

You can get a DUI just sitting in a parked car if the keys are NOT in the ignition. In Louisiana, you can be considered to be operating the car if you have the keys and can access the ignition. Best thing to do if you have to sleep it off is to put the ignition key in the trunk and keep the keyfob to open the trunk with you inside the car.
