Then the lawyer isn't familiar with state law?

Dannheisser said the boy’s family is “actively offering support to the Gartenbergs in reaching an appropriate agreement with the County seeking a means of the dog returned to them with assurances designed to protect against a repeat of this risk to others. I am optimistic that at the end of the day we will be successful.”

It's a well established fact if you're a dog owner and it bites someone, even on your own property, you're probably going to be held responsible for that dog's actions. The laws vary from state to state, but in most instances, no matter what the circumstances are, the owner of a dog is held legally responsible if that dog bites someone.

Thank you.

If you're asking me who I would be more inclined to believe, I'm going with the babysitter. Animals do unpredictable shite sometimes. Could the sitter be lying? Absolutely, but you know the vet's non-witness story wouldn't hold up in court. Maybe I'm naive, but I'm always going to believe the person that was there until proven otherwise.

Can you show a case where that happened and the dog/owner was found responsible?

Because if that's the way the law works, I can go in your house and frick with your dog until it bites e and then sue you. I highly doubt that would fly in court, but perhaps you can prove me wrong.

No one is arguing that the vet shouldn't help with medical bills, at least if someone did I missed it.

This is about not putting down a dog that was antagonized unknowingly by a little kid and reacted to being cornered.

Honestly, it should be a non-story. The vet should separate animal from his customers, help with medical bills, and the family should be fine with that.

Yea, not like she has any stake in blaming this on someone else.

Yes. It's also why I shake my head at kids in college who own pits and other big dogs. Does the parents insurance cover them?

Got some bad news for ya, burglars have sued homeowners for hurting themselves in the act of burglarizing the home, and won

Link to one that isn't made up.

ETA: Better yet, don't because it's not relevant to the situation discussed. Surely a case like the one I asked for would exist, because some POS would have surely taken advantage of such a ridiculous law by now

Another example of how fricked up our legal system has become. Our country is overly litigious and its an embarrassment.

See: Personal Injury Law.

If my dog is pestered by a kid and cornered and it snaps on him I can be sued for everything I own for "emotional distress", etc.

But, that's not the point of this thread. The point of this thread is to discuss if the dog should be put down. I think its absolutely asinine and a gross over reaction to put this dog down, judging by the information we have been given.

Just stop leaving it out with customers in case another child comes in and fricks with it.

People are at fault here, not the dog IMO. Babysitter, vet, kid (age obvi absolves him of respons.), etc.

I think what we're seeing here is people approaching this from an emotional standpoint and allowing emotion to cloud their judgement when it comes to the vet's story.

Or we're skeptical of the claims of a personal injury attorney?

Let's be honest here. You're correct in saying you've shown a good deal of skepticism about the babysitter's version of events. But you've also made it very clear you've completely bought into the Vet's version of events. You've picked sides on this issue when, if you were to look at the issue objectively, you'd see that there is no way for any of us to know what actually happened. Along with this, logic also dictates there is responsibilities that were neglected by both the vet and the babysitter. You've been very vocal about holding the babysitter responsible but have been silent about the vet's failure. The truth of the matter is you've allowing your emotions when it comes to dogs dictate your stance on this issue. And that's fine, just be honest about it though please.

I know this wasn't directed at me, but I want to comment.

I don't care who is at fault. I think it can be split up amongst several parties; vet, babysitter, kid, etc.

I just don't think that dog should be put down, based on what we know. That's my end-game argument in this thread
