Divorce/alimony after < 1 year of marriage

Friend made a mistake at the beginning of covid and married a crazy woman around March 2020 (legit borderline personality type, not the typical “all women are crazy” type). He’s filed for divorce recently. She’s asking for alimony despite being married less than a year. If she gets alimony, is the length of the monthly payment equivalent to the months married? No kids. He makes a lot more money than her. Could he offer her 10k or so to “go away”, and come out ahead due to lawyer costs for both parties? No infidelity or anything egregious on his part, not sure about her.

What would be a break even point for a 9 month marriage without kids? 15k? 20k? 30k? Assuming he makes six figures, and they both agree to drop lawyers for the majority of the proceedings?

Legally speaking, for 6 months he will have to maintain her to the standard of living at which she is accustomed until the judge signs the final judgement. I don’t think she’ll walk away for only $10k. Maybe, but who knows. If he filed before January 1, 2021 they will have to claim as filing separate on income taxes. Due to the fact that the IRS requires the receiver of alimony to pay the taxes on that money, your friend should leverage the IRS tax code. He should offer her a sum that below which would/could put her into a higher tax bracket. Also, make sure that in the Final Judgement it is spelled out that she gives up any and all future claims for spousal support and that all Community Property has been separated and both parties agreed to the manner, method, form, and amount. Hope this helps your friend.

Louisiana has temporary spousal support (up to 18 months) and "permanent" spousal support.

Thanks for the detailed response. I honestly think he just wants closure. I suspect he would probably prefer to pay 30k up front and be done with it than have this be drawn out for a year and end up paying 2k a month for 12 months in alimony.

Depends on the state but in my state (TN) a marriage less than a year she isn't getting anything except 50% of whatever accrued in the how ever many months they were married, which I assume is very little. He may consider paying her 10 grand though. If she's crazy, she'll drag it pout unnecessarily and he'll end paying his attorney more. He also could possibly be hit with temporary support during the case, so that's something to consider as well.

Not anymore. That changed January 1, 2019. For Decrees of Divorce entered after December 31, 2018, alimony is no longer deductible to the payor nor is is taxable income for the recipient. What it has resulted in, generally, is lower alimony payments. Orders entered prior to January 1, 2019 are still tax deductible for the payor and taxable income for the recipient.
