This is different however. Spreading demonstrably false information that exposes ABC to a lawsuit is almost certainly a breach of Kimmel’s contract.

The FCC may have commented, but I doubt that it had too much effect. It rarely does.
On the other hand, the loss of revenue from affiliate stations and associated advertising has a real impact.
