But you’re passing judgement on someone and saying “what they should have done” while not knowing their BAC or their level of impairment.

I just don’t think this is cut and dry as many of y’all are trying to make it.
Holy shite, READ THE AFFIDAVIT.
There were about 10 different points in which a normal, reasonable, decent person would've realized that this girl was incapable of consenting or truly understanding what was happening. MULTIPLE - multiple - noticeable instances of this girl being completely incoherent and intoxicated.
And that is by one of the perpetrator's OWN accounts. There had to be a dozen more signs he didn't even bring up to the investigators that this girl was incapable of consenting.
She was passed out, slumped over in the back seat at one point. The first rapist had to ask her 5+ times if she wanted to have sex. OVER FIVE.
So on that 6th time when she was able to muster a "yes", you think a normal, reasonable guy would think "well there's the green light, she clearly consents!" HELL NO. They knew exactly what they were doing, and if you tell me you'd have sex with a girl in that same instance... Well then, you're a rapist.
Then came the second guy. He had to ask her another 5+ times in order to get a response from her. OVER FIVE AGAIN. And again this dude just went about his business sodomizing her, to the point that she had physical, visible injuries even after the accident. Meaning this is clearly not something this girl often (or ever) does, and was so incoherent he was able to continue long enough and rough enough to leave physical injuries.
And you want to play devil's advocate and say "what if she really wanted all that?"
If you read the affidavit and come away with the opinion that maybe these dudes aren't guilty of rape - VERY CLEARLY, by the way - then you're a creepy, rapey motherfricker. Doesn't matter if they were drinking or high themselves, this girl displayed numerous upon numerous signs that she was incapable of consenting and incoherent.
They knew exactly what they were doing, evidenced by the fact that they just dumped her somewhere random without a care after having this "glorious consensual sex". The driver of the car felt so bad about the occurrence that he showed up at the police station mere hours after the incident and spilled the beans to the cops.
At no point did these guys do anything that would constitute anything BUT a rape. They had numerous chances to do the right thing - or simply just NOT HAVE VAGINAL AND ANAL SEX - with her, but they chose to take advantage of her in her state.
Now, kindly frick off all of you that want to take ANY angle defending the actions of these guys or what they're accused of. It's cut and dry, by one of the perpetrator's OWN accounts of the night.
I added emphasis to certain words and sentences so maybe you - and the other few "we all wanted to hook up with drunk chicks at bars in our youth" rapey posters would maybe get it through your heads what *actually* happened

If this goes to trial, I would hate to be her parents when the defense tries to paint their daughter as a drunk slut that wanted anal and vaginal sex from two different people in the back of a truck. That would almost kill me to hear someone speak of my murdered daughter that way.

Would the charges change to reckless homicide and 1st degree rape if a witness came forward from Reggie’s who claimed something was slipped in her drink and the accused perpetrators in this case tried to get her to go with them?

Buddy, this is Louisiana. We drank all thru high school to the point of puking etc. This shite never could’ve even entered my consciousness in any state. Do we all regret things? Yea like plowing over a mailbox for fun after some beers, not fricking assaulting a female and ruining her whole life.
