be possible. First specimen was taken as soon as she arrived in the ED. Second specimen was taken after she received a liter or 2 of IVF. This should not be hard to determine provided the collection times were accurately documented.

It’s very clear nakamoto is on the side of the rapists. It’s like he slants his reports to make everyone believe the way he does. From his interviews with the defense attorneys to this.
Also, let’s not forget the dna expert who is also defending one of the rapists telling us the case should be dismissed.

I tried to tell y'all in real time this wasn't going to be a easy as y'all thought. This is really bad for the prosecution. Physical evidence is 100x stronger than testimony and they can't prove intercourse happened.
First degree rape requires rape, which is defined as:

Without DNA the prosecution cannot prove penetration.
It becomes a question of reasonableness, and without DNA 1000 reasonable scenarios without penetration just entered the chat.

I think it’s safe to assume that the defense is only going to leak evidence that helps their case, no? So we don’t really know what other physical evidence the prosecution has.
Speaking of which, I wonder how the judge will react to the defense leaking discovery materials to the media. Didn’t they already get their hands slapped once?

I’m not sure I agree with that. They have the defendants admitting there was intercourse. The lawyers stood on the courthouse steps and had a press conference and said there was consensual intercourse. Now they are going to try and say no sex happened at all.
Also, I imagine here, a rape kit wasn’t performed until the next day. She was hit at 2:50 am January 15. At that point she’s just a drunk girl hit by a car. Police have no reason to suspect sexual assault.
January 16 police talk to Carver and he tells them she was raped by the two dudes. That’s probably 30+ hours after the rape. I’m sure they will be able to explain the delay in doing the rape kit and how that could impact results. Also, may be a process for harvesting her organs that could hav compromised available DNA on her body.
I think given their own statements and the statements of their lawyers on the courthouse steps it would be stupid to try and deny sex even happened at this point. They are better still arguing consent (especially if they can convince people she chased after them when leaving the bar).
Once they try and deny sex at trial, they cant be like well, just kidding she consented.

Exactly. It would have been better for the defense if the accused and their lawyers just remained silent. The attorneys have said publicly, several times, that sex DID happen. And said so on video.

Mokdaf said detectives seized the videos from the defendants’ cell phones and social media pages.
An employee from Reggie’s sent Carver a text message Jan. 15 asking him for the names and phone numbers of the men Brooks was seen leaving the bar with; that's when the four defendants began discussing her death in a Snapchat group chat and coming up with a story for authorities, prosecutors said.

If this is true, the defense had better get ready to start plea bargaining for the least amount of jail time for their clients.
And why would they be stupid enough to film such a thing? I mean, let's say she lives and decides to go to the police later on. Normally, it would be a he said/she said case. But with film evidence, the prosecution has a much stronger case. And deleting it from your phone doesn't work because deleted messages and videos can be recovered. Plus, deleting things makes you look more guilty.

Her dad is suing the bar, LYFT and the 4 defendants. While he may get money from LYFT and the bar, I doubt the 4 defendants can come up with $20 between the 4 of them.
